Company\'s refusal to renew H1/H4 since we have EADs . Help needed.

My company is refusing to renew our H1/H4, which expires in May 2002. We do have our EAD\'s, and our RD at INS(N) is Feb\'01. What are the pros and cons ? Advise required.
 
YOU DO NOT NEED A H1 IF YOU HAVE EAD

   I don\'t think you need a H1 if you have a EAD. As per me your status is being adjusted and H1 is not requires. If you wish to travel just take a advance parole
 
I was having the same problem a few weeks ago

My case is a bit different because I haven\'t applied EAD yet. I talked the lawyer to renew my H1 but he told me my company doesn\'t want to renew the H1 as I will be getting the EAD soon. I talked to the HR manager and after a "lengthy" discussion, the company approved so I am now renewing my H1. As for your spouse, if he/she has already filed I485, he/she doesn\'t need to renew the H4.

For my case, it was $ issue but the HR manager didn\'t explain the problem directly to me. I told her that I am willing to pay for all the expenses.

EAD is always better

you need to stick on to H1 only if you plan to bring your spouse in H4 (for the first time). With EAD, you can switch employers without any problem. You have to proactively renew EAD, since if your EAD expires and you do not have the next EAD, you cannot work legally.
Travel with AP is not a very big issue. With EAD you can also take up a part time job, work in other MSA, whereas you have to amend LCA everytime you go from one place to another. EAD is definitely cheaper overall for companies, since the burden now falls on the candidate.
