Company name change

I'm working here as H-1 holder. My company name changed recently (this year).. I heard two stories about it
First story is that if company name changes i should apply for H-1 visa again becase INS considers it's different company.
Second story is that if company's Federal Tax # is same even though company name has been changed. it's same company so i don't have to applay H-1 visa again.
Which one is true?

This is unrelated issue..
I'm trying get visa stamping on my passport in my country.
Should i hire laywer for preparation? or could i prepare for myself?
I do know what i need to prepare & i do have all the neccesary paper works. Do you guy who got their visa stamping alrealy did you prepare for yourself or laywer did for you?
 
Maximum required might be a H1 amendment, in most cases nothing is required.
Rarely people use a lawyer to get the visa stamp in passport. Most of the US consulates have a website listing documents required and procedure ...
 
Even my company changed their name. I don't know whether they did my H1 ammendment or not but I'm all my payrolls and stuff are done on the name of the new company.
 
Not a big deal - just make sure the company files an H-1 amendment to reflect new name, just so that there's no confusion for other immigration processing down the line (for GC for e.g.)

Where can i find info. about it? (actually i don't know what is H-1 amendment)

Please help me i'm plan to go back to my country for H-1 visa stamping.. (do you think i should file H-1 Amendment before i leave? or company name chang document from my company would be enough?)

You need to get your H1 amended . Dont even think of going back to your country & Getting and your H1 stamped , they will not do so . To get your H1 amended talk to your lawyer they know how to file an amendement , but remember this case will take the same time as it takes for the normal H1 to get approved. Unless you apply for Premium processing.

Do get your H1b amended in the new name.once you get the new approval notice then get it stamped in your country . FOr docs go the US consulate website of your country and look under non immigrant visa section and there u will find all the details ,no need for lawyer there.

is there ANYTHING, ANYTHNG i can do except filing the H-1 Amendment for now?

My company name change is official as per today (01-27-03)..if it helps my company federal tax id is the same. (my laywer said if tax id is same it's the same company..i don't know whether INS considers it same)

i have personal obligation to go back to my country within a month... i'm trying to get H-1 stamping from F-1 - OPT.

Filing an amendment will not affect your travel or visa stamping. If tax id is the same then you dont have to worry.
 
Call the Consulate

You can do one thing call/write to the consulate where u want to get your H1B stamped and see what they say .

According to the rule if just the company name has changed and all the other things like your position and employent offer etc remains the same then u dont have to get H1B amended but the US consulate in your country might not accept it and would demand a amended H1B from you .

I had the same problem in which you are in now so i advised you to get the amended H1 . Why dont you file for premium processing of H1B amendement. Trust me its worth than going back and getting stuck there .
