Clarification on H1 filing.Please help!!

Hi,

After filing H1,Can a person travel on B1(he has valid visa) in the mean time until the H1 gets approved?.

Will this affect any way travelling in B1,as he has filed for H1.Unreliable source says that a person can't travel on B1 when he has filed for H1.

---YES, becase H1 is not filed by YOU it is filed by US employer, Once you get H1 visa stamped then the consulate will cancell B1. till the time you did not get H1 visa stamped you can visit US on B1

------- what source ???? US employer files H1 petition with USCIS then it has to be approved then you go to consulate for H1 visa stamp.US employer filing H1 petition does not mean that you cant visit US on B1. visa is under DOS and petition approval is under USCIS.

actually my friend came on B1 and stayed here in B1 for 5 months.She went back and now if she comes back on B1 again for 3 more months,while her H1B was being filed(filed on 5th June),will it not be a problem as the officer can be suspicious she has come to work on B1 and possibles to trouble her at port of entry.
