Hello All,
I'm planning to file N 400 this week. I ran into part 7 where I need some expert guidance in filling the form. Part 7. Time outside the United States.

From the time I got my GC I have made in total 20 international trips.
15 Business Trips averaging 5 - 6 days/trip.
5 Vacation trips averaging 25 - 45 days/trip.

I drove by Land to Canada 5- 7 times and each trip was between 5 - 7 days.
Since, I'm unable to track the exact date, I plan to enter the following.
Total Trips to CA 6. Approximately spent 6 days/trip.

Total Days Spent outside USA is 265 Days. (out of 4 years and 10 months)
Questions.
1. Will the no of trips cause issue while determining the case?
2. Will the total no of days (265 Days) spent outside US cause issue while determining the case?
3. How to handle CA trip in Part 7 and what will be the impact? (I could not trace by any means)

Any input is greatly appreciated.

Also, For my wife N 400 I have the same part with Continous residency. She has been to home country 4 times and 2 times she stayed for 154 and 179 days. (the longest period were due to the medical fact that doctor prescribed her to take rest for 6 - 8 weeks)

Below are the details.
Time Spent Outside USA
___________________________________________________________
Left US____Entered US______Days_____________Months
____________________________________________________________
04/24/2005 07/21/2005 Days 087 in terms of months 2.86
10/21/2006 04/19/2007 Days 179 in terms of months 5.88
10/17/2007 03/20/2008 Days 154 in terms of months 5.06
12/02/2008 01/17/2009 Days 045 in terms of months 1.48
Trips to CA appr. 6 Trips
Totaling appr. 30 Days Days 030 in terms of months 0.99
____________________________________________________________
Total Days/Months Spent Outside US 495 Days in terms of months 16.27
from the time we got the GC.
_______________________________________________________________
Questions.
a. Will the longer stay in home country cause issue while determining the case?(even meeting the criteria of less than 6 months)
b. Will the total no of days (495 Days) spent outside US cause issue while determining the case?
c. Will the no of trips cause issues?

I can probably try to get doctors recomendations letters from US and home country to provide the necessary supporting documentation. Also, I was residing in US during those period to show proof of residency for my wife.
c. Will she be risk if I file my wife's N 400 application at this time?

She meets the eligibility requirements but, I don't want to take risk.
Eligibilility Requirements Months___Eligibility
Time Spent outside USA 16.27____Falls within the requirement.
Time Spent in USA 41.03____Falls within the requirement.

Questions.
1. Will the no of trips cause issue while determining the case?
No, as they are short trips spaced over the entire statutory period.
2. Will the total no of days (265 Days) spent outside US cause issue while determining the case?
No, as you have met physical presence requirement.
3. How to handle CA trip in Part 7 and what will be the impact? (I could not trace by any means)
Can you track the Canada trips down by month and year? If not, guesstimate how many trips you have taken to Canada and disclose that on the form.
Any input is greatly appreciated.

Questions.
a. Will the longer stay in home country cause issue while determining the case?(even meeting the criteria of less than 6 months)
It may lead to more questioning at interview about intent, but otherwise it shouldn't be an issue.
b. Will the total no of days (495 Days) spent outside US cause issue while determining the case?
No, as she has met physical presence requirement.
c. Will the no of trips cause issues?

No, as they are spaced throughout the statutory period. If the two longest trips were spaced apart by only 1-2 weeks, then it may have been more of an issue.
I can probably try to get doctors recomendations letters from US and home country to provide the necessary supporting documentation. Also, I was residing in US during those period to show proof of residency for my wife.
c. Will she be risk if I file my wife's N 400 application at this time?

Best Regards,
If she meets the requirements, she may still be questioned about the trips. Just be prepared to show evidence that you remained in US and that the trips were for medical reasons. I don't forsee any other issues for either of you .

Thankyou Bobsmyth for your detailed response. I appreciate your detailed response.

I will go ahead and file the N-400 application for both of us this week. Wish us good luck. I'll update the forum as I file.

Thanks.
