My case:
Permanent resident since 2009, spouse is US-citizen since 2005.
We went overseas in July 2013 with reentry permit, returned back in July 2014 after 364 days, one day less than a year. We thought that she can apply for naturalization on 2 years plus 1 day rule and filled N400 application in July 2016. But now when I am searching internet, some people are saying 2 ( or 4 ) years plus one day rule applies only if someone is in overseas (out of USA) for more than a year. It don’t apply if someone is less than a year overseas. Now my question is
Weather 2 plus one day rule apply if someone is out of country for more than 6 months but less than 1 year ( 364 days ) for US citizen spouse? Please help as her interview date is approaching and it will be highly appreciated. Thanks
