Please help Citizenship interview and ticket for unknowingly serving to minor

Hi gurus
My wife have an appointment for interview for citizenship on November 16th. she
helps me out at my liquor store, mistakenly she served to minor and got ticket from arkansas ABC agent. i have heard my friend's wife have to reapply because she was on probation and they told her they cannot let her take an interview because she have to finish her probation,please advice me since it being first offense for her and store i am sure she can also get probation.Will probation affect her interview should we let io know even he/she don't ask or just tell if they ask because her court date is November 9th.please let me know what could happen

Don't lie about it. She WILL be asked about ANY arrest, violation, citation.............

Getting caught in a lie over something like that CREATES a brand new BAR to GMC for five years from the date of the lie until allowed to re-apply on a new N-400. She needs to throw herself on the mercy of the Court and tell the judge about her upcoming N-400 interview and how such an HONEST MISTAKE could delay or prevent her naturalization if she ends up on probation. Beg to pay a fine rather than probation IF it is not dismissed outright.
 
Thanks bigjoe5, do you think the probation could prevent her naturalization and paying the fine and let the ticket be on her record for next 2 years will not prevent her naturalization because i have to make up my mind about what to do?
 
I gave it my best shot. Any further questions after reading the following regulation and I suggest asking a lawyer.

8 CFR 316.10 (c)(1)

Effect of probation or parole. An applicant who has been on probation, parole, or suspended sentence during all or part of the statutory period is not thereby precluded from establishing good moral character, but such probation, parole, or suspended sentence may be considered by the Service in determining good moral character. An application will not be approved until after the probation, parole, or suspended sentence has been completed.

Unknowingly Furnishing or Selling Alcohol to Minor

3-3-201(a): The sale, giving away, or other disposition of intoxicating liquor to a minor is declared to be a misdemeanor.

Penalties
■1st offense: Fine - $200 to $500
■2nd or subsequent offense: Jail Time - No less than 1 year; Fine - $500 to $1000


The penalties given are min and max, I guess probation would fall somewhere in between. It is certainly NOT a required consequence.

they moved her court date on nov 23rd now we are in limbo i guess now everything depends on io
 
The officer gave her the ticket learned from me that she can have problem in her interview. he thought it would help if she gets court date after interview so he changed it somehow and called me later after it was done so now i realy don't know what is the result would be
 
She should be frank and honest about the situation at the N-400 interview and ask that she be allowed to try to resolve the situation before a decision is made on the N-400. She is innocent until proven guilty. It was a mistake after all, even the ticket is for UNKNOWINGLY etc.... If she can get it resolved with a mere fine or even better would be a dismissal. You won't know until she has her day in court.

I hope she can get it resolved in her favor.
 
BigJoe5 thank you and everybody else she was asked regular questions during n-400 interview the lady who was interviewing her was same rude one i had 5 years ago she was real scared she wasn't asked about any ticket or anything all she asked about did u ever got pulled over and got speeding ticket which she never had so she said no and she was ready to pull out ticket to show it to her and she asked another question so she didn't brought it up thinking about the question i told her to look out for "have you ever commited crime for which you were not arrested?" and "have you ever got arrested cited or detained by any law enforcement etc" but she never asked those questions.so when she came out i asked her about it but she said she was too scared and she passed it now we are awaiting oath ceremony. I hope nothing goes bad now
 
She committed perjury and has attempted immigration and naturalization fraud when she signed the N-400. She should contact the Officer and clarify the situation before it is too late. She was nervous and confused and can still straighten things out. These things do come back to haunt you. Google for news artcicles about Pedro and Salvacion Servano.

She does not want to be in THAT company, does she?

Does she intend to LIE AGAIN at the Oath Ceremony? She must complete the questions on the back of the Oath Notice. Google for "Form N-445" to see the questions.

Your wive wasn't scared and confused, she knew what she was doing. I wonder what is the basis for your hope that nothing bad happen between now and the oath ceremony? Your wife should have stopped the officer and indicate she was cited for selling alcohol to a minor by mistake, indicate she was cited and had to do probation for which she is completing or completed it (don't recall which is), and produce the evidence. What she did was stupid, especially when her offense is such a minor issue that won't affect her naturalization now or in the future, it doesn't rise to the level of lifetime bar to naturalization. I wonder if the officer knew that she had this offense and wanted to see if she would be truthful and just approve her case and recommend it for approval, only for this information to be used to deny her N400 for lying for USCIS. I can't see anything good coming out of this issue, especially as the US law tend to bite people 30 years past their original offense.
