Hi

I have lived in US since 2001 and got my greencard in 2004. I am planning to apply for citizenship now. 4 year ago, I had a domestic quarrel with my wife and this resulted in me being arrested. However charges were not filed and I was released. It was an unfortunate incident in our lives.

Will this impact my citizenship application ?

Thanks
Steve

you have to disclose the arrest and an outcome documents (release etc).

If your wife was the sponsor for GC, it could raise some questions for GC.

Hello DreamUSA

I will disclose the arrest and attach related documents to N-400. Does anyone has more info to share on impact of this on citizenship application? Anyone can share their personal experience with this situation ?
My wife & I are together and live happily after this unfortunate incident. It was a lesson learnt.

Thanks
Steve

An arrest in itself without a conviction is not an issue for GMC determination. Just make sure to disclose it and provide court/arrest documents showing that charges were dropped.

From my personal experience I was arrested and have no criminal record. When I went to my interview on Jan 11 for naturalization, the officer was happy to see that my arrest was after 10 years. He kind of made a remark that if it was before that it's not past the statue of limitations. It's hard to say what an immigration officer is going to say about the arrest. To show good moral character they like to see 5 years plus since an arrest. I would wait if I were you or contact an attorney. Best of luck.
