cites between interview and oath ceremonie

Hey guys i got today my oath letter and the ceremonie will be february 18th. but there is problem.I got a cite last month for failing to pay $ 3 at the airport for picking up my personal customer as a cab driver.The court day is on february 4th .But my lawyer advised me not to wast money getting a lawyer because he said thats nothing.
My question is ,if i disclose that by checking yes on the question on N 445, what is going to happen?Are they going to withdraw my naturalization.
Please help me please.thanks a lot

What is the charge? Is it something like traffic violation?

I don't thinkit is a big deal: there are three possibilities (1) They still allow you to take oath (2) They will pull you off the oath and review it and then see itis OK and reschedule you another oath date
(3) deny your application. It depends upin yoru charge and maximum penalty allowed by law. If it is very trical I think possibility (3) is not likely.

By the way, are you a cab driver by profession? Did you list that as your employment? If you do you cab driving moolighting and do not list it on N400 then if they know you got yoru citation as cab driver, they may also
make an issue out of it. It is not that important but they may want to see your tax record etc
 

That thread is about traffic violation but what the OP got may not be a traffic ticket. He failed to pay $ 3 and law may consider that to be something equivalent to theft of 3 dollars. At oath ceremoney people may let traffic tickets go but are not sure what to do with other kind of violations and if they don't know what to do they may need to consult their supervisor so they can delay your oath. I suggest the OP go to oath appointment as early as possible so that hopefully the oath bailiff may have enough time to get a supervisor to review it on spot and then let him take oath

Also, I am not sure if the citiation you are mentioning is from any law enforcement agency.
It could be a fine from a private agency that does airport monitoring. A notice/fine from a private company would not be considered as a citation.

The OP got a court date so it must be a citation from law enforcement. No private agency would want to waste time going to court for $3. At least they would
send you a bill first to let you have a chance to pay before they file a civil lawsuit over 3 bucks.

Even my lawyer does not know what kind of ticket was it .that not a crime .they just tried to let me pay a fine for failor to pay 3$ at the airport.
yes i put taxi driver in my application and also a schedule c for my tax

what suprising me is I checked the ticket statut many times at the court by entering the ticket number online but so far it is not on their system.It `s been 6 weeks now and the court date is in one week
 
I missed reading the court part. Since there is court date mentioned, it is an official citation.

I would say do as WBH suggested. Go early to oath ceremony to explain the citation.

If I were you I would pay... Please do not waste your time listening that laweyer... $120 you can save somewhere else...
Pay the bill and keep the reciept with you .. just incase if you asked at oath ceremony otherwise no need to say anything...

Itis not" in case". He is asked by a wriiten question on N445 form

In interview doc check list the wording is like this... so you say still he need mention that in N445 form?( Just curious I dont mean to counter argure )
"unless a traffic was DUI or serious personal injury to others . you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine of less than $500 and /or points on your driver's lic"

I guess you have not seen an oath letter yet. The oath letter (N445) specifically ask "including anyh traffic violations".

And we do not know what is the OP's charge. the OP's ticket may not be a triaffic ticket. He might have been failed to pay $ 3 for something else. For example, he may run thru a ticket booth and in my opinion, that is not a traffic violation but more like a theft.

Even though I never got an oath letter (I had my oath few hours after interview), at the end of interview the IO specifically adviced me, make sure not to get any tickets before oath.

Is airport police considered as part of the goverment law enforcement or are they part of a private security company (i.e., university police)? Maybe a citation from airport police does not quality as a citation from the city police...

It will be said very celarly on citation. Terminology is very different between civil law suits and criminal lawsuits. I don't think any agency, private or govermnetal will file a civil lawsuits over $3.
 
That`s a good question.that need an answer.Do anybody know if airport police is part of the law enforcement?
 
I know that at O'hare, in Chicago, there is Chicago police no airport police, so getting a ticket at O'hare is same as getting a ticket anywhere in the city.
 
Some local government can give private security guiards certain arresting power usually for nonviolent misdemeanor.
