Hello All:
I am new to this chicago DOL.. & glad to join you guys...

Ohio SESA fwd my labour to Chicago DOL in Apr04 ( first week).

How are the approval statistics for RIR cases in Chicago? How fast the cases move in chicago?

Even I am new to the Chicago DOL. Can anyone please tell me from where did you get the case number. My employer says there is no way to know what is your case number as they didnt received it. I filed my labor in first week of October.
 
chicago DOL

WHats happening?

Case filed June 2003
Moved to chicago DOL July 2003
Remanded to state October 2003
Reply to remand January 31 st 2004
State approved February 02 2004
Moved to chicago DOL (After reply to remand) February 5 2004
Now the status is 'Return by the state after remand' per the past 2 1/2 months
No news after that

Any idea?

spark - my $0.02:

it is like this ..at first the LC application is sent to state SESA office, and upon review and clearance by them it will be sent to DOL. Now this 'review and clearance' includes checking the veracity of the position advertised by teh firm, applicability of the candidates credentials for the position and the results of good faith recruitment efforts by the firm to recruit locally available talent for the advertised position.

Now, even if the state SESA office is okay with everything, DOL might request for further efforts/Edn quals ..whatever if they feel so!!!! and so they remand the case back to state!

some very imp things to keep in mind include:
1. ur firm is really profitable with a good no. of employees (my yard stick is atleast 50+ employees, 5mn$+ turnover)
2. You get very good educational credential evaluation
3. ur firm is really in RIR status (ensure that they were advertising for positions to include atleast 60% of ur skills at the rate of atleast one ad per month in the prior 5 months to ur date of LC application)

if teh above three are satisfied, the chances that the case will get remanded are less.

Will that mean my case is going to take longer than expected or Is this a normal process?

My company has more than 200 employees. My degree is equivalent to MS in US. I am assuming that, they would have done proper advertisement.

Is this happening to every one or at random... Please response

Hello Guys,

It looks like Chicago DOL and the state SESAs falling in that region are the fastest in processing labor applications. I am looking for a company that would sponser me for the green card, preferably labor substitution if they already have an approved labor. I have a project in hand and looking for a company who would sponser my GC.

BTW, what is the meaning of ACTION1 : Cert ?

I see that Case#5430500 was RECD on 11 Feb and Cert on 18 Feb

Does it mean it the case was approved by DOL with in a week?

Surprise! I was also doing that randon followup! I have the results in the Excel file and I have attached the same here.

Some facts about this file:

1) I was always interested in finding out what was the last case number they had updated in AVM. So it is not continuous running numbers.
2) Off late, I was working on finding the latest cases only. so some cases in the earlier dates I have not updated the correct status.

Couple of suggestions:

1) Since copying the results on to the post directly would make all of us to scroll through the result a lot
2) We can take turns and update the files and
3) most importantly, instead of we doing the random followups, if all the forum users in this thread can put in their cases and status that would give us a lot more information.

Please drop in your suggestions.

Please anyone clarify :

My case was moved to DOL on 9Apr2004.. but today 16Apr2004 when I checked the chicago DOL AVM 312-353-1059 - using my employer phone no.. AVM replied not a valid phone no..

1. Since it is more than a week, how & when the case no is assigned?

Hi AnbuFl,

You got wait atleast couple months for your case to appear in AVM. Mine was forwarded to Chicago DOL on Jan 27th,2004 and still not in the system.

My case was send to Chicago DOL on Jan 8th 2004 and it still does not show in their database - just wondering how long does it take to show up in their database.

koushikreddy please post a reply or e-mail me when your case shows up in the Dol database.
 
Earlier it used to take 6-8 weeks to enter in AVM. Jan end onwards things have slowed down considerably.

And nowadays it seems they are still working on Nov cases and have not updated AVM after that except for special cases.
 
Hello guys,

You guys have been waiting for the labor certification as everyone else. So I thought you must be having a better idea about the processing times. Can anyone enlighten me how much time Chicago DOL is taking to process the labor certification RIR cases? Also which SESA in chicago region is the fastet?

To partly answer your question, this web page (http://workforcesecurity.doleta.gov/foreign/times.asp) lists current processing times for all SESAs. For Chicago region Nebraska and Kansas seem fastest under RIR. My labor was completed some time back under RIR where it took a total of three months (including SESA - Nebraska and Regional DOL - Chicago). Apparently things have slowed down at Chicago lately. Maybe someone else could answer your other question better than me.
