change of status tn to B2

Hi to all,

My son will be 21 years this December and need to change his status from TD to B2 (tourist). Is this possible or need to leave the us and back as tourist?

If this is possible, where can I find the requirements for it?

experts on the forum can comment but my understanding is after 21 yrs of age, he is on his own. As a tourist, there is only some much he can do...cant stay more than a certain period of time and will have to leave the US after that. I think more importantly, is there a reason why you want your son to return as a tourist i.e. on B2 status, there isnt much he can do?

nelsona is clearly the main resident expert. I believe your son would need to change his status within the US by a mail in change of status as he won't be re-admitted as a B2 tourist unless and until he re-establishes Canadian residency. He would do this using Form I-539. Looks like your family will be celebrating Christmas stateside this year! I agree with mister that this can only be a short term solution. He can only stay a limited amount of time on a B2. If the family wants to stay longer he needs his own student visa (if in school) or his own work visa (if working). If he qualifies for neither, you need to find a viable option for him to return to Canada. But the B2 will at least buy you a little time to sort out a longer term plan.
 
Both correct. Your son needs to be making concrete plans to either move back to his home country, or find hos own status. He should be doing this well before he hears back from USCIS on the outcome of his I-539 request for B2.
