Guys and Gals,

This latest bulletin only fuels the thought that our only hope in this process now is a change in the laws. With congress divided on the immigration reform bill I am not sure if anything can happen this fiscal year (ends Oct 06).

At this point it seems that a lot of visas in the EB3 category will get wasted because they won't be used before Oct 06. The DOS and USCIS is scared of April 01 and the year 01 in general. Although they have very little conrete evidence to go by they are being very conservative in moving the dates and are thereby screwing us over.

The only positive scenario I can think of now is that the USCIS will move dates rapidly in the months leading upto Oct 06 (July-August- Sept) in a mad rush to use up all the left over visas from 06. Who knows.

The worst case scenario I can think of is the system getting flooded by 245i cases and most EB3s getting stuck at April 01 or retrogressing back.

USCIS has to be made accountable

USCIS and DOS are still playing a game to show to the lawmakers that USCIS is well within the target of 6 months processing time. Their gameplan seems to be to limit the inflow of I-485 filings by totally arbitary priority dates. For the backlog, persons like us who are waiting for visa availability are not counted.

Unless the lawmakers ask for data howmany Employment Based green cards have been issued in the first 6 months of the current fiscal year and make USCIS accountable for processing the quota allotted for the fiscal year, this game will continue and a lot of visas will be left unutilized at the end of the year.
 
Well, while I agree with your thoughts, I( many like me) are still stuck in the "name Check/Security clearance" hell. Not sure when we can get out of it. My case is current now/ has been current on/off.

I can only look :mad: at the institution that is stil keeping my file for the reasons known to them.

Good point! They can fool us, but have to tell the truth to the senate. I'll bet USCIS has issued very limited number of GC visas of EB3 category for this fiscal year so far.
 
Well, it's look like I will continue with the "renewing my EAD and waiting for a miracle" to happen.

But, Cheer up!! It's still early, nobody knows what will happen, let's hope for the best.

We need to keep our hopes alive. We have to continue fighting this system and find a way how to make our voices and opinions heard.

I totally agree with you. What's wrong with these people? it's nuts!
By the way, I heard a rumor from friend's lawyer ; He said that before the month of August nothing much is going to happen.
I can't beleive I'll need a 4rd EAD and AP, how bad is that?

The April Bulletin - Can't believe this.

From Saras76's experience, applying EAD well in advance also has an adverse effect. They issue the EAD effective from the day they approved the EAD and not from the day from the present EAD Expires.

Not only this, They denied my I-131 Advance Parole Document application because I sent it to USCIS (Texas) earlier than 120days. THIS SUCKS they took my money and because I sent me a denial letter than I applied the renewal of I-131 document 120days before my old I 131 is getting expired so they are dening it. IT SUCKS!!!!!! they should have returned my application instead.
Also they changed my dates for EAD That I am still fighting with them.
Seems like USCIS is a big money making Industry in USA who is making money by streching longer the GC process and making money from thousands of people like us who have to apply for AP and EAD every year. Seems Like SCAM to me.
 
I totally agree with Chakor , Name Check is an even bigger problem . I am stuck with Name Check since Oct 2003 and cant even find out now as the PD is retrogressed and FBI has stopped answering emails .
Its hard to keep the hope alive in these circumstances .
