Change in employer’s company name with I-797

Hi all,

I obtained an approved I-797B form and am planning to cross the border soon to activate the TN status. (I was out of the US when I filed.)

Unfortunately, the company recently rebranded to a new company name. Do I need to refile a new petition with USCIS or is my current I-797B sufficient to cross the border?

Nothing about the company has changed (no merger, no acquisition), just a corporate rebranding.
 
No. You may just want to get a letter from them stating that OldNameCo they are now doing business as (d/b/a) NewNameCo.

That is only because you are going to the border now, If this had happened six months from now, you would do nothing.

(I guess there was little point in filing an I-129.)

Thank you for your response! May I clarify what you meant about "little point in filing an I-129"? Would I need to complete a full interview at the border or will a letter stating the company's change in name (as you suggested) sufficient?

Apologies, also to clarify, was the “No” in response to not requiring another petition with USCIS or that my current petition is NOT sufficient to cross the border?

You do not have to submit a new I-129. The letter would be sufficient to show that your company name has changed, as a precaution. The border officer can do a quick look online and not find the old company, which could be problematic. The letter solves this.

Whether or not your sponsor filed an I-129 and you receive approval outside US, you are subject to full review at the border the first time, and can be denied. SO filing I-129 is of little value unless you are 100's of miles from the border, or in some country overseas. Otherwise, simply showing up at the border gets you the same result as filing, with no cost and no wait.

How long was the process between your job interview and getting the I-797?
