career advancement and I485 does it have to be a choice?????

Hello everyone,

I, two days ago, got a surprise email from my lawyer announcing that my labor certificate has been approved.

I had almost given up any hope to obtain the certificate, and thus, decided to go on with my life by applying for a top MBA school.

the greencard and the admission are most valuable to me. Is it possible to get both?

To ask a more specific question, can I go back to school while pending in I485?

Sure, but you need to ensure your proferred job will be there at the time of I-485 approval, that's all.

Could you get into a little more detail into it?
Do you know where I can look this up?

And what status would I be admitted in?
not a foreign student, not a permanent president, not a H-1B professional.
 
What you can do is file for 485, and then you can get into MBA for instate resident, u don't even need an F1 visa, continue your studies, try to graduate soon

The only catch is that at the time your 485 will be approved, you will have to have a job that matches the job description on your Labor Certificate.

You don't have to work while your 485 is pending, and so you can study full time, and you may also work part-time if you wish. Just make sure you have an employer ready to give you an employment letter with your job title/description same as LC at them time your 485 is approved.
 
After graduate from TOP MBA school, you are most likely take on a CEO of some sort, which will invalidate your labor.
 
You don't have to wait for your EAD, if you can start now, then start now

And after graduating from top MBA, you can get a job with a scope bigger than that mention in the labor, but still covers the labor. For example. If your labor is for a a developer then after MBA you can get a job that is project lead, managment and stuff like that and this will not invalidte your LC, it just depends on what the LC is filled for and what job you have, as long as you can get an employment letter with the job duties matching the one on the LC you are covered.

I need to make my status clearer.

I just got my LC and is preparing to file I-140 and I-485. These documents should be in by early Febuary.

My LC is for a software developer. I think it is quite likely for me to find a software development manager job after I graduate from MBA school.

However, I still have three questions.

1. When can I go to MBA school based on the immigration status? Do I have to wait until I-140 is approved? or is it permissable with INS to go to school after I-140 is filed?

2. Several friends on the waiting list for I-485 told me that INS will be pinging my employment status. If I leave my current employer to go to school, the employer will have to report to INS that I am no longer with them, and INS will usually request me to show them another employment letter. Is this true?

3. Both AP and EAD card need to be renewed every year. Do they require an employment verification?

Each schools have different set of rules, some schools will consider you as an instate studnet if you have 485 filling receipts, some schools will require a valid EAD card, some school will accept H1-B status, there is no set guidlines set by USCIS that the schools have to follow, you need to talk to the school that you are interested in.

I-140 and I-485 is for a future employment, and so you don't have to be working at the time your 140/485 is filled. Your employer has to be willing to produce a letter in which they mention that they intent to employ you in future with the job duties matching that the one on LC.

Renewiing EAD/AP will not require employment verification.

If your employer files your 140 and then you leave him, then he can revoke/withdraw the 140, if you are sure he will not do that, then you are safe. Also he has to not revoke/withdraw the 140 for atleast till it is approved and 180 days have passed since your filled for I-485, so that you can use AC21

This means that if I-485 is filed for more than 180 days, my employer will not have any impact on my GC process, right?

What is AC21?

Do you have any law documents or links to documents that will list some the "DOs" and "DONTs"?
