Canadian TN w newborn w LPR husband?

Hi,
I'd like to get your thoughts.

Im currently in Canada and will give birth in a week. Baby and I need to be with husband in US. I was denied B2 at 6mo because of possible anchor baby issues and lack of Canadian ties, so they told me to try again in 6mo after developing more ties.

This year I plan to visit again after my 6mo and perhaps a couple of times until I'm ready to find a job. The family Green Card route doesn't seem possible as the process times for LPR has retrogressed (correct me if I'm wrong) and our family maybe split up for years. Husband needs another few years before US citizenship.

So I'll search for a job in August with my MBA + Engineering degree. Will I have an issue getting TN + TD for baby on the spot at border? I prefer TN over H1b because H1b is a bit more of an undertaking for employers and perhaps limits my job options. However if this is the only choice, I'd have to keep finding a job until someone is willing to sponsor H1b.

Any thoughts appreciated.

Your problem is admissability due to immigrant intent, since your husband is in US and you've already been denied entry, so will be subject to scrutiny. The baby is really secondary in this.

Yes, FB has retrogressed, you missed the opportunity.

I would be trying to find a job, attempting to get TN (your previous attempt to cross may have killed any hope for that), and then if denied, begging for employer to get you H1. You will be doing this all from canada, I'm afraid.

The spouse of LPR situation is a nasty one. At least with your education there is hope for H1 entry.

It may be time for your husband to also be looking work in Canada, to be with his family.
