Canadian on TN to marry USC

Hi

I am working in US for several years on TN and I just changed my TN when I switch job in February and I am getting married to a US citizen in April. We were planning to visit parents overseas after the wedding and come back with my TN, but I read several articles, and found out that might not work. What should I do then? Can I still keep my TN after I get married? Or should I apply for Green Card, but am I even allowed to if I'm on TN?

I just answered a similar thread by CAgirl, please read response ther. Basically you must marry andhoneymoon within US, and get all your paperwork done before leaving US after marruage, or you will lose both work authorization and the right to live in US.

I meant I just changed my TN last month and getting married early next month. Will I be able to do adjustment of status in less than 2 months?
 
Of course you are. marriage-based GCs are very forgiving for entries made just before marriage. You are worried taht you somehow could be viewed as having obtained your TN under false pretenses (ie. knowing that you were going to immigrate). Thios would be a concern if you were getting a work-based GC (since there would be some collusion between you and your employer that the DHS *could* go after).

But they don't do this in marriage-based GCs.

You won't get your GC in 2 months, but you will get your AP (which will allow travel and keep your Adjustment process alive) and your EAD (which will allow you to work) with 2-3 months. You'll get your GC sometime later, but the AP ans EAD will suffice in the meantime.

Until then, you stay put in US and at your current job under your TN, which remains valid until you set foot out of US.
