I have a leagal status of H-1 B from US based company and I am a landed immigrant. I want to visit india in december and would like to come back in janauary using US port of entry. Do I need a visa stamp for H-1 from india?

will be ok if i have valid H-1 approval papers and I-94 ?

please help

I have read on some DOS site that being Canada PR you dont need US visa if you are from India and XYX country can enter US, but lot has been changed and changing everyday, do not take the risk.
Better you should get your H1B Revalidated in US from Department if your previous H1B visa sticker has not expired more than 1 year, you can get your passport stamed in 2-3 weeks time, one of my friend got in 10 days. for more inforeagarding Revalidation go to www.immihelp.com
OR
you should get your H1B stamped in India, take all the papers employer letter, 2-3 recent paystubs. If you had previous H1B visa stamped you can use Dropbox.

You will be fine. I have not done it. But from what I read from the US Consulate web site, it clearly states that you do not need a visa. But If I were you, I will keep my ears and eyes wide open. Don't know when DOS will pass the new law. In case if they pass the law, you should be able to obtain the stamp in India. Carry all of the necessary papers required to obtain the stamp.

Also when you leave US on your trip to India, you will have to surrender your current I-94.

Can you verify with your friend whether he really recived his H1 stamping on PP from st louis in 10 days. The various websites and the lawyers say it takes 6 to 8 weeks.
 
It is very rare for one to receive a visa stamp from St. Louis in 10 days. The normal processing time is 6 - 8 weeks. I wouldn;t take any chances.
