Hi Gurus,
My 485 is pending. ND march 03. VSC EB3.
My question is :
Last week I got letter from canadian consulate according to that my Canadian greencard is approved and they want me to make passport stamp in new york office or by mail.
If I do this stamp on passport then is there any negative impact when I go for USA Greencard stamp ?

They will ask any question about : why I took this canadian greencard while my USA GC is pending?

Any reply is appreciate.....

Thanks

----- no questions of Canda PR becase you will get US green card after the canada PR
Any reply is appreciate.....

Thanks

The Canadian officers won't ask you any questions when you land in Canada. just formality (your Canadian address, your occupation, anything to declare, etc.). Canadian officers in NY stamp your passport won't ask you any questions about your pending US GC case.

When you go for US green card stamp, they won't ask you either. Just surrender your I-94, eads, ap, 2 photos, and I-485 approval notice. That's it. There will be no negative impact.

but later you have to make a decision to surrender either one (Canadian PR or US PR) to live and work permanently. You can't maintain both.

Hope this helps.

nycindia,

I went to Canada last month got my PR card applied and came back to US, I even spoke to my attorney before I got it stamped, they said you can have 10 Green cards and still can apply for US GC, USCIS cares only about US GC only, whether we meet the validity criteria or not to keep int US GC.

so you dont have to worry, even go and come back on a week-end time, so that you can apply for PR card in Canada POE.

US GC- Pending Canada PR

I'm working in USA on H1-B visa and my green card is being processed thru' my employer.
I had filed my I-140 and I-485 concurrently about 6 months ago. I have gotten my EAD card but I'm not using it and 'am still on H1-B visa.
In the past, I had filed for Canadian Permanent residence also. I got my Canadian Immigrant Visa stamped on my passport.

These are my questions if I visit Canada:

1)If I do so, will it affect my current Green Card processing in USA in any way?
2) How will I get the Canadian PR card as I'm not aware of the whole steps/procedure involved?
3) What's the best way to go to Toronto for entering on first time on immigranvt visa ---Flight/ Car?
4) Can I come back the very next day? If so, will I be asked any questions by the Canadian Border/Immigrant officer while leaving the country.
5)Do I need to provide a mailing address in Canada to receive the PR?
6) Will I be asked any question by US Immigrant officer while entering US such as purpose to visit Canada? What should I answer them?
7) Do I need to apply for Health card/medical insurance in Canada as I read in one of the postings but it was not clear.
8) Also, will it create any problem while entering USA after visiting India or any other country on vacation while still on H1B with Canada Immigration Visa on my passport?

I would really appreciate your reply.

Thanks.

1)If I do so, will it affect my current Green Card processing in USA in any way?

Ans. No it will not.

2) How will I get the Canadian PR card as I'm not aware of the whole steps/procedure involved?

Ans. While in Canada, you will have to contact local immigration office. They will walk you through the process. In addition, there are a lot of agencies in Canada who will charge you a little fee to help you with these documents.

3) What's the best way to go to Toronto for entering on first time on immigranvt visa ---Flight/ Car?

Ans. It does not matter. I would personally prefer Flight.

4) Can I come back the very next day? If so, will I be asked any questions by the Canadian Border/Immigrant officer while leaving the country.

Ans. Yes you can. There is no Canadian exit interview. You don't even see them. However, In order for you to complete initial paper work in Canada, you would need more than one day. e.g. SIN, Bank account, Driver License, applying for health card etc.

5)Do I need to provide a mailing address in Canada to receive the PR?

Ans. Yes. You should not use an address outside Canada. You will run into whole bunch of issues when applying for Canadian citizenship.

6) Will I be asked any question by US Immigrant officer while entering US such as purpose to visit Canada? What should I answer them?

Ans. Yes. General questions. They will definitly ask you why you visited Canada, you can tell them that you are also Canadian resident and you had to go there to take care of some paperwork.

7) Do I need to apply for Health card/medical insurance in Canada as I read in one of the postings but it was not clear.

Ans. Preferably yes.

8) Also, will it create any problem while entering USA after visiting India or any other country on vacation while still on H1B with Canada Immigration Visa on my passport?

Ans. No.

Disclaimer: Please understand that I am not an attorney. I have answered your questions in light of my own experiances. Immigration laws and procedures change very often. If you need up to date legal counsel, you must contact an attorney

------ when you land by air or border post Canada immigration will ask Canada address for PR card and they will mail the PR card to Canada address and your friend /relative in Canada will recieve the PR card in mail, later he can send you your PR card in US by fedex . make sure at the time of landing if the photograph for PR card is good or will take new photo

-------- by air is better

-----no, you will not face canada immigration when you depart Canada but you will face US immigration at Toronto air port before taking a flight to US
5)Do I need to provide a mailing address in Canada to receive the PR?
----- yes, yes, at the time of landing
6) Will I be asked any question by US Immigrant officer while entering US such as purpose to visit Canada? What should I answer them?
--- generly not, if asked tell the truth(they will know from the passport stamp of canada immigration)

----- in Ontario you CAN only apply for health card AFTER 3 MONTHS OF LANDING and you need proof of canada address, any utility bill on your name, bank account on your name. you can apply SIN card, go to nearest HRDC and it takes only 15-20 minutes and SIN will be sent to canada address
