Can we file H1B transfer & 7th year extension together in one H1 filing?

Hi,

I am with a company A and want to move to company B since company A is going down. I have a LC pending more than 365 days with company A. My 6 year H1 expires in July 2004. If I transfer my H1 to company B, I have to file 7th year extension before July using company A's Pending LC, instead of two filings can I file for transfer and asking for extension also. Does any body went thru this situation and got approved?

---- USCIS is not clear on this topic, you need to contact good lawyer he may be able to give you a good reply.

** For 7th year H1 extension you need the evidence that LC by Company A was filed 365 days back. Do you have that evidence with you? If not try to get LC filing receipt that was sent by SESA or SWA to lawyer after LC was filed that receipt has case #, PD, your name as beneficiary on it, you need the copy of that receipt and that is evidence

Yes I do have a recipt from California EDD (SESA) for LC filing. It has my name as beneficiary and has priority date also.

My concern is whether my new employer can file H1 transfer with 7th yr extension. You are right I should get a good lawyer's advise.

FYI, I applied for H1 transfer and 7th extension with premium processing. Got transfer and extension also.
