Can one apply for H1 while K1 is already applied?

Dear All,

I need suggestion and help from our guides here on the forum.

We have applied for K1 since month. Can please suggest if we can try to apply for H1 also in parallel? Will it hamper the K1 Process? Is It ok? Or any harm?

Please suggest.

Yep- you can apply for 2 visas at once (not too sure exactly how the pre-conceived with having a K1 petition on the go will look though) , but applying for a H1B while having a K1 in the works seems like a whole waste of money. H1B is an expensive visa to apply for, and if the application was successful, its not good to use until October 2010....by which case your K1 visa 'should' be approved.

Q1. """ its not good to use until October 2010...."" why do you say so??? This year is a little different.....Due to bad market, the H1 cap has not expired, so there still are empty applications left for outside world, and INS will accept applications till they get exhausted.

If H1 gets approved in 2-3months, then cant one just come over to US? Why does he or she has to wait for October 2010???

Ahhhh- youre prob right about the H1B. Usually the alloted number of visas get allocated lottery style on the first day they come available and so if you dont get a visa at the beginning of April, then the next time you can apply for one is the following April as this is when the next H1Bs come available....so I was assuming you would have been (well, the employer would have been) applying for one in April 2010. When they get issued/allocated in April, then the actual visa is good to begin work in October (think its October 1st)...though as the select number of visas available havent all been used this year, then Im guessing youre right, then can come over once the visa is issued.

Its great that your fiance has an employer lined up to sponsor them though.....usually its really hard for someone to find someone willing to sponsor them, do all the paperwork and pay all that money to get them a visa, so its great that they have that option :)

btw, I dont have an employer yet to apply :):).. was thinking whether its worth to put in efforts to find one or not...and whether its allowed to apply together or not !!
