:mad: Guys, i am screwed. This is what they give me after 29 months. And after 14 years of working hard in this county, this is what i get!!!!

I had my FP1, FP2, 2 times medical and still they think their as reason to transfer my case to local office. I just got two emails from USCIS, stating:

2 friends of mine also got the same notice and got his interview in pittsburgh in 2 months in jan and march very complicated cases.
 
Some case randomly or for some 'reason' are picked for interview. May mean some more delay but not necessarily anything much to worry about. Maybe a positive sign.

I am sorry my friend. I would judge the credibility of the officer as the vermont. Now they have already lost all my hope!!!

Does anybody know local processing times for Atlanta? Where i can find them. What timeframe applications they are processing?

I am sorry to hear of your shitty situation.

there is really nothing anyone can say to make you feel better right now.

you have done all what you can to hurry your case, you have contacted senator etc etc

this is something that is out of your control, so as hard as it is, try to relax and accept that this is happening. it is certainly not your fault.

of course it does not feel fair to see others approved from late 2002/2003-- and of course it makes no sense to the thousands of us still waiting.

but-- if you have AP and ead then you can work and you can travel and maybe you can look at this as a bureaucratic nightmare and let it take its course. I know that is not at all easy to do

have you ever seen a GC denied here on the boards? -- no matter how tortured the process?

perhaprs you can take some comfort from this

Sorry to hear this, My friend. this is outragous! unfair! ask Rajiv, maybe your case could be used in the court to show how 'fair' the CIS is.

how long does Atlanta office to schedule an interview?

in any case, don't let CIS tear down your life. I was very depressed too, but started to take life more positively. look for all the good things in your life.

you might try call all the local immi lawyers in Atlanta area and ask if anyone could speed the interview process, sometimes, local lawyer has majic power.

Was there something in your case that was very complicated?? I mean why transfer at this late stage?
 
I think everyone understands your frustration. I saw one guy in 485 issues in TSC thread getting interview in Atlanta in 3 months time. His interview is actually on 6/7/04.

On the other hand talk to dsatish and see how can he and other team help you since he has this effort going on to help people, may be you become their first beneficiary.
 
Unfair

Here are some things that you might want to consider. Some apply to all of us seniors in waiting.

1: Let Rajiv know about it. Maybe you can play a more active role in the lawsuit. Your case exemplifies the unfairness rampant nowadays within USCIS.
2: Contact your congressman for an expedited processing request in the Local Service Center. Sometimes, they have more power when it comes to their Local Processing center. Provide some reasons beyond the extent of the processing so far. i.e., your contributions to society wrt to your taxes (total) paid so far to Federal, SS, etc. Never collected unemployment, etc. Went to church (or mosque, or your religious place) every week and helped the poor. Point out the current mess and processing times for USCIS, i.e. late 2002 and early 2003.
3. Send an e-mail to the Ombudsman: Prakash.Khatri@dhs.gov and/or CISO@dhs.gov. Complain and ask for expedited processing. Remind him that according to DHS Act he has to give a report to Congress this June.
4: Complain to the Press. See my thread, "Immigration / Press". Yesterday, a BBC correspondent was complaining about his AP. His e-mail is at the end of the article.
5: Above all: DO not let anything get you down. And by the way, there is no 8th year H1-B as far as I know, unless you leave for a year and start fresh. Better, since seven years of H1-B were basically useless in a way.
 
Tufan - I understand your frustration..!

Sundancekid was right.. We haven't seen any 485 denied cases so far.
So I think there is nothing for you to worry about in the long term. Just hang in there and call the Atlanta local office, if you can directly, to get an idea of the Local Processing Times. Although its frustrating the good thing is atleast you would know soon most likely when a decision will be made in your case(when the interview is scheduled..)
See if you can follow cinta's suggestions..

Cinta, my lawyer got 8th year extension for someone. He said they have to give me 8th year extension since it's their fault about the backlog.

Sundance, thanks for the kind words. I am not afraid about any rejections however, this is what i was not expecting after all this wait. What i am concerned about is the timeframe, as Atlanta sucks in terms of processing an interview.

So.. .. that's my concern.
Don't really know where to go from here.
 
I'm really sorry. This could happen to any of us. In fact in one of my posts I did mention a growing trend of RFE cases being transferred which I felt was like adding insult to injury. I don't know whether this is directly connected to our contacting the Senators. If my case case gets transferred too I can bet that they're trying to get back with a vengeance because we contacted the Senator. I hope your interview gets scheduled soon and that this nightmare ends for all of us. Best of Luck and take care. Try and take off your mind off this GC thing as long as life is good otherwise. I know it's easy to say it but difficult to act that way 'cos I too feel very frustrated with this whole thing but we're pretty much helpless against the USCIS.

Sorry to hear about your transfer. While nothing can be attributed to a logic with USCIS, your's might have been transferd as you had 4 address changes and notified them all. One more penalty for being honest and respecting the law.

It looks like Atlanta is processing May 19th 2001, as of 5/13/04 posted dates. Its hopeless to see most of the district offices are as sc**d, if not more, as service centers. Only almighty could help us all.

This is a really a shit work which was done by the Service Center.....sorry for that happened to you after long wait.

Now, I am afraid as my RFE was also same - for Medical. Lost the hope.

RFE Received - 5/20/04 Medical, Employment letter, and I-94.

Can you think of any reason why they transfered after RFE?

AC21, 245(i), changed employers etc?

I also got my RFE 6th April and now worried, if this case transfering is becoming a practice with DHS.
But I read it the other day that receiving 2nd FP after RFE is an indication that RFE has been cleared.
I know its not the right time to ask questions to you but just learning from your bad experiences.

Bottom line is- the GC process sucks and it tests your patience. So all of us have to be patient and put up with it. :rolleyes:
You are Dec'01- we can see many many much earlier cases still pending. ;)

My deepest symathies to you for getting transferred to Atlanta locan center which is one of the worst local centers based on the time it takes for interview. I saw that you have already posted messages in the Atlanta locl transfer thread and it seems the wait time is horrible. I hope that the law suit will put pressure on these local offices and things should improve in later this year. Also the immigrationportal.org is going to put lot of pressure on INS through the congress men and one of our biggest complaint is going to be the transfers and delays at local offices.
As for the reasons for transfer to local office, i think that they have some internal guidelines (unpublished) about what type of cases should be transferred. It could be random also. But i have observed that most of the people who have honsetly filed AR11 or AC21 got transfers. This may not be a rule (they have absolutely no rules),it might also depend on the adjudicator. I see absolutely nothing to worry because based on the experiences of a lot of people who had interviews, it is just a 5 minute routine questions.

I don't think this CIS will act on on vengence for contacting Congressmen/Senator. It well might have been but I doubt it.
You might have been xfered for making too many inquiries. Your frequent nquries might seemed to CIS as a person who is too eager to get his GC and this might have aroused suspicions as to your intentiion. There was a case sometime back abt a person who frequently and without been asked for, sent documents in support of thier 485. Instead of a quick decision, CIS investigated that person for fraud. CIS deemed that person to be too eager to receive their GC.

I am just playing the devils advocate here. I am not making any judgement on you. I am in the same state of helplessness over GC appl. So I do understand your need for more information on your 485.
