As for the reasons for transfer to local office, i think that they have some internal guidelines (unpublished) about what type of cases should be transferred. It could be random also. But i have observed that most of the people who have honsetly filed AR11 or AC21 got transfers. This may not be a rule (they have absolutely no rules),it might also depend on the adjudicator. I see absolutely nothing to worry because based on the experiences of a lot of people who had interviews, it is just a 5 minute routine questions.

Actually, on March 9th, Senator office told me that USCIS is considering transfering my case to a local office, however then on March 11th RFE was generated for "medical" reasons. Therefore, on April 16, USCIS received my RFE and then i was just waiting for "Dengdeng" theory to work. It was shocking to see those emails from USCIS as no boby had expected, including myself that my case would be transferred to the "WORST" processing center.

I have been with the same employer since filing. They did not ask for employemnet related information. I guess they had already made up their minds. They just wanted to get papers for medcial as local offices don't handle RFE's.

My H-1B is expiring in 1 month. I am going to be filing for both H-1B and EAD/AP.

I don't think address change or anything is the reason. I came to the country in 1991 and did my BSEE. After that from F-1 i went to H-1B. I am thinking that might be the reason, due to 9/11 maybe they want to verify my in person.

For sure they don't care that my case we already pending for 29+ months at Vermont. Again, their's no theory that works with VSC and nobody can tell what they will "gift" you with next.

NOT EVEN GOD can help me now.

You can say it's my bad luck.

Tufan: I am totally disappointed to hear about the outcome of your RFE Response.

This is totally OUTRAGEOUS, I just don't understand what USCIS wants from us to prove that we are trying to live in the country LEGALLY.

They have all the restrictions, painful processes and laws for the people who are trying to follow there LAW and those who live illegally in the country doesn't have to go through all this pain (I hope I am wrong).

But situation is, what I figure out so far, if you try to do anything LEGALLY in this country then you are SCREWED, better get off without even getting touch with these BASTEREDs. They are here to just give us PAINFUL life that is effecting our family life as well in lot of ways.

Don't worry about what could be the cause. We have repeatedly seen that the interviews are farce. They just ask 3 or 4 routine questions and stamp your passport. God only knows why they have to transfer the case for such non issue cases. The bottom line is 'they don't have any rules'.

Every body here is more or less in the same boat :( . You have a big company out here :rolleyes:

Hey cheer up. It's not the end of the world. The same thing happened to me but it turned out not that bad.

When they transferred my case to local office, I did not even know since the Service Center neven updated on line. I was in the dark for almost a year
until I heard from local office for an interview.

I was really mad also and felt hopeless but what you could do but take it one day at a time. It turned out that my case was orally approved at the interview and about 6 months later with the name checked cleared, my case finally approved. The case took 2.5 years.

Just hang in there for a couple of more months and your turn will be here.

One more advice: do not get paranoid. It is most likely a random transfer.

I'll pray for your approval.

Hey, dont worry too much. I know its easy to say but try to relax.

Yes, Atlanta office is very slow but that could change overtime. Last year the Arlington office was taking 10 to 12 months to schedule the interview, now its down to 6 months. And dont waste any energy guessing the reason for transfer, most times there is none.

By the way, I had my interview this morning and got approved. Read the following thread for moe information.

guys... the reason i am frustrated that we all were expecting my approval after 29 months. Plus RFE was sent in as well. However, they had to give me a gift in return.

I am not concerned about the interview as i know, everybody goes through. It's just the timeframe/paperwork/headaches.

Guys.. here's the problem. Could you please confirm local processing times at Atlanta? Do they go based upon RD (12/01) or transfer date from Vermont, which is May 20th(2004)?

Secondly, i'll be moving once again from Charleston,SC therefore, which address do i give so that my case does not gets transfer from local office. I'll be moving to Greenville, SC??

My lawyer is telling me to have the file transferred to Pittsburgh local office?

Please suggest ASAP.

Most of the service centers go by date transfrred to local center :( . For exact clarification on Atlanta center, send a private message to "TheRealCanadian". His file is sitting in that center for the past 2 yrs or so.
you may also send a PM to "feb6361". He met some INS officials at ATlanta office and asked for expedite request.

As for change of address, if you can have an address in Pittsburgh and get the file transferred there, it will be cool. If you move to another place, you can ask the Atlanta center to transfer your file to the new place. One of the example is "freenation" who got his file transferred from Florida to Newark,NJ.

Sorry to hear abt ur case transfer. I am sure your approval is on the way sooner or later but right now you have only option to wait for interview letter from local INS office. I know it is better said than done but at this point one can do nothing. Try to follow up with local INS office abt your interview schedule and ask the time frame.

Transfers are processed in the order of RD. You should be getting something with 6 to 8 months. At present Atlanta is doing July 2001. I know it sucks to get something like that but if you manage yourself to get through this then in your life you should be able to get through anything.
Whether it is one month or 1year it will evently pass. Think about how many years you already have lived and they passed like a moment and rest of the time will also pass.

thanks for your support. I have a question for you. You had mentioned in the thread that Atlanta goes based on RD date, not the case transfer date?

Could you please confirm that for me? Where did you check Atlanta is processing July 2001?

When i talked to 800# they told me that vice versa?

Please shed somelight on this.

My RD at VSC was 12/17/01,
however case transfer date to Atlanta is 5/20/04.

Please help as i'll be moving again and i need to decide to give address in Atlanta or elsewhere so that the case does not gets transfers based upon jurdiction
