can I use AC21

Here is my situation:

I changed job before 140 approval, and before 485 pending for 180 days and started new job immediately. <180days

Now 140 is approval straightly, and 180 passed of course.

Can I use AC21 or should I send AC21 letter or just wait for 485 RFE?

Go to BCIS online status check the status of I-140 to make sure it is approved and not revoked by past employer if it shows I-140 approved take the printout

If I-140 is APPROVED AND I-485 is pending more than 180 days you can use AC21.
It is better to inform USCIS with I-485 filing reciept that you joined new employer and send new employer future job offer lettet

Thank you for the reply... YES, I-140 is approved and the previous company said they won't revoke it....

so if i send AC21 letter, maybe I should avoid mentioning the date on which I joined the new company? because of the <180 days issue...

Per attorney It does not matter. If you feel compfortable you can do that. My case was similar to your case. I did not include start date either.

Changed company twice one after 10 days of filing I--485(laid off)
Second time after 5 months after filing I-485. All on H1. Never used EAD. wife used EAD.

I changed job after 100 days of 485 filing. still on H1B though I have EAD and AP. and 140 just approved. so far have not filed AC 21 yet.

--maintain H1 status and file H1 extension before your H1 or I-94 expires it is better to be on H1 status, dont use EAD
