I have a valid H1B from my previous employer that expires in 2006. I also have a valid visa stamp for this on my passport that expires in 2006. I changed my job a few months and the new employer has filed for H1B for which i have a reciept notice. I need to take a trip to India next month and i doubt i will get my new H1B approval by then. Can i enter back in US with a I797A from the previous employer and valid H1B Visa stamp with annotation of my previous employer and the reciept notice for H1B application from current employer?

Please let me know
Thanks..

Thanks for the reply. I appreciate it. I just want to clarify something.

I am not sure if my previous H1B is still valid, I mean on the I797A it has a validity date upto 2006 but my previous employer could have canceled it once i quit that job. I have a current H1B application pending and have a copy of the receipt notice. Basically i have a valid status as the current H1B application was filed while i was working with my previous company but can i still travel having a multiple entry visa stamp on my passport, my previous employer's I797A and a copy of the H1B receipt notice from current employer?

Please let me know

Thanks

------Employer can only revoke/cancel the H1 petition NOT the VISA STAMP in passport, USCIS has nothing to do with H1Visa stamp as consulate or DOS issues Visa stamp

-----Keep the receipt with you

----- Yes, show passport Visa and enter ( no need to show valid H1 approval notice of past employer or receipt of H1 transfer filing, show ONLY if asked)

*** Go to USCIS/BCIS site to check online status of your past H1 approval status, punch the EAC or LIN WAC # of your H1 approval notice and check if that has been revoked or still shows approved.
You can also check the past employer H1 approval status on 1-800-375-5283
Let us know what status it shows for your past employer H1 status

Thanks for the info.

I checked on BCIS site for the status of my H1 from previous employer and it shows that it was approved.

---- You are OK to go and come back, no problems.

** if your H1 transfer or extension gets approved while you are out of US then ask your employer to send you the new H1 approval notice, and show your H1 Transfer approval notice and passport Visa stamp that way you will get new I-94 till new H1 transfer validity at POE, if the officer gives I-94 till Visa stamp then ask him to correct the I-94 or ask for supervisor by law you will get new I-94 till your H1 transfer notice. if you dont get H1 Transfer approved and reach US before transfer is approved then new I-94 that will come with H1 transfer will be your latest I-94

Same situation

Hello,

I am in the same situation as you Karanwaiting. I changed my employer, my new h1b came through and I even have the approval notice. I have a valid visa in my passport stamped through February 2006 from my previous employer.

I need to make an urgent trip in September to the Bahamas and it is not possible for me to go to India to get the new visa stamped before then. Can I go and return to the US on my old visa and new approval receipt? The only other option I have is to try and go to Canada before then for a stamping. Any advise is appreciated.

Thanks
