Can I re-enter USA using my H1B visa from previous employer (valid till Jan 2009) ?

Hi all,

My H1-B visa from my previous employer is valid till Jan 2009. I changed jobs and I currently have an approved I-797 (with I-94) valid till May 2009.

Can I now make a trip to India and re-enter US using my previous visa or should I compulsorily get a new visa stamped?

You don't need to go for visa stamping. You can come back with the old visa stamping and at POE show the new I-797 which is valid until May 2009. They will issue the new I-94 which will valid until May 2009. I have done this.

But i think while leaving you have to surrender/give your both I-94's at the airport. I would take copies of both I-94's and carry few pay stubs and EVL letter from the current employer.

Hi Satgym73, thanks for your immediate reply. I have a doubt: When I am leaving the country, how will the airlines (the ppl who get my I-94) know that I have changed my job? Can I not just give my old I-94 and keep my new one safe inside?
 
By law, you have to surrender both the I-94's. I hope other peoples from this forum will confirm about this.

You must surrender bothe the I 94.

You should not keep your self any I 94 with you while leaving the country, it may affect your future re-entry.
