can i get H1 visa if i'm freelancing?

hi, i have a full-time job but i am considered a freelancer/contractor. can i still apply for an H1 visa? my employer suggested i become incorporated and file for a visa that way, and i also heard about applying for an O visa. has anyone else been in this situation?

any advice is greatly appreciated.

sorry about that -- i am a second year graduate student, graduating in may so i am on F1 status. i still have 10 months left of my OPT and i have a job offer for full-time but as a freelancer (no benefits). i am worried that i won't be able to apply for H1 visa in this case and i was told that i should become incorporated. what is your opinion about my case?

In my opinion, you should find a company offering a full time job and be able to apply for H1. If not then you should get H1 thru a consulting company. That consulting company will offer you a full time job and then find you a project or you will yourself find it. It is not practically possible to get yourself Inc. at this stage and do freelancing.

Look in the employer's section of this website and you will find some companies offering consulting jobs. Do your homework before joining any company. I will suggest you do it soon otherwise your H1 application may not be considered towards 2006 quota.
