I filed 1st 485 in 2005 this was filed under future employment, I sent cancellation of 140 and 485 as soon as I received the approved labor from my original employer for which I am currently working, I did not get any cancellation notice, I filed 140 and got approved recently, now I got my priority date for 485, can I file 2nd 485 when 1st is in pending? I got the EAD approved from 1st 485 which I did not use so far. My main question is when I am filling 2nd 485 form there is a column asking whether I filed Permanent resident status before, what I need to say ‘yes’ or ‘No’? if I say yes I might mess up my current 485, if I say NO then what happens, is there a system for INS to check I previously filed, or will they come to know automatically that I have filed before as my file is opened, please advise I am confused what to fill.

Can I file 2nd 485 when 1st 485 is pending

--- YOU cant cancell I-140 it belongs to employer

----------- you got the Labor approval???? just reciving the LC approval does not mean I-140 filing or I-485 filing. need details in steps with dates

You may want a direct answer. ----------- check your pending I-485 Reciept it has A# on it, it should be written on any form filed in future( if your wife is also sending second I-485 she also need to write her A# on the I-485 form check her earlier filed I-485 reciept and it has A# on it
