Hi All,

I filed my GC through my employer's lawyer. Now I am changing the employer, can i change the lawyer also? Can lawyer create hurdles for me because he works for my current employer? I signed and submitted form G-28 (authorization for the lawyer to represent me) when I filed my GC. I am afraid my employer and his lawyer will create problems for me. Shall I file a new G-28? How to do it? through new lawyer?

Thanks,

Sham

Hi All,

---------------Yes, let new lawyer send fom G28 with copy of your I-485 reciept notice.
Can lawyer create hurdles for me because he works for my current employer?
------------------why to inform past lawyer that you revoked his form G28 or new lawyer sent G28? only USCIS gets the info who represent you when your new lawyer file new G28.

------------------dont inform them that your new lawyer sent G28 and they will not know.
Shall I file a new G-28?
How to do it?

------------------if you want to revoke the G28 filed by lawyer XYZ then write a letter with your name, DOB, A# and I-485 filing receipt number, Address and write to USCIS (where I-485 pending) that you request to revoke the form G28 filed by lawyer XYZ that lawyer sent with your I-485 and lawyer XYZ no more represent you and USCIS should send any future communication to you directly on your address………… also attach the Copy of I-485 receipt notice. You must sign the cover letter with date. Keep the copy of each document that you send to USCIS. Out side the envelope write in big bold letters ATTN: Request to revoke Form G28 with pending I-485. you dont need to send new G28. if you hire new Lawyer then he need to send G28. Only lawyer need to send G28. if no lawyer represent you and you need direct communication to you on your address then G28 not needed.

through new lawyer?
------------------if you hire your lawyer he can send G28 signed by you.
Thanks,

Sham

Thank you

Thank you very much Ginnu. That was really helpful. I don't know if i have a copy of 485 receipt notice or not. Because lawyer was handling things, I don't think he sent me any receipt notice. They didn't send me i140 receipt notice and similarly they didn't sent me the 485 receipt notice. I have notice of action for finger printing, etc. I dont know if that can be helpful.

Sham

I-140 is employer petition. Employer or lawyer may give you copy of I-140 reciept or I-140 approval copy or may not give you.
I-485 is YOUR petition. you can always ask the lawyer/employer for I-485 filing reciept and they have to give you the copy of your I-485 filing reciept.
