Can I change job while I485 pending? Please help!

Others may have asked this question many times. But appreciate if someone can help me:

My I485 was filed on Jan 2003. FP done in March 2003. I140, AP, EAD all approved in the past month or two. I just got a job offer from another company which is more exciting than my current one. Can I change my job? If I can, what will happen to my I485?

Please advise.

Yes you can if you are 180 days from the reciept date - check the other threads on this forum for more details.

Generally people say that after 6 months there is no problem in changing employer after filing I-485. however there are various possibilities that you may have to think off.

if you change your current employer, he or she may send a letter to cancel your green card under such case INS may send a letter saying that your current employer has cancelled your greencard and then you have to consult a good lawyer who will advice you how to handle this situation. I am sure under such case it is likely to take more time than expected under normal processing as well as it may create more complications or it may happen that you may get RFE from INS to prove that though your employer has cancelled, you still have a job to stay in USA and if you don't get any RFE then you are safe.

People say that generally you are safe after having filed I-485 because employer does not have much control on your greencard and you have job when you get query from INS.

It is safer to change job after completion of 6 months from the date of filing I-485.

I would consult a good lawyer for this.

and past employer should NOT revoke your I-140, your new employer should pay you minimum wages written on your LC, job should be same/similar and new employer should be ready to give you a letter ( when needed) that he has Permanent job for you.
Still no final regulations on AC21
 
A more conservative opinion

It is safer if 180 days have passed since I-140 is approved.
 
Q on changing job within 6month

If the I140 is approved based on NIW, I remember you do not need to stay with the company for 6 month. You can change job if you want. Am I correct?
