Hello

I am a student in NY, I have completed my continous residence eligibility and physical presence as well. I am being financially supported by my spouse who is on a H1B (work) visa.

Can i still apply for naturalization?

Do i need to specifically show his name and an affidavit of support, paystubs?

Please advise
thanks

If you otherwise meet the eligibility requirements of 5 year rule, you'll still need to disclose your spouse on application. There's no need to include affidavit of support from spouse, but it doesn't hurt to bring it to interview in rare case that IO wants evidence on how you were supported during statutory period.

Thanks BigJoe and BobSmyth

Actually i got my gc in Aug 2002
But i was in and out of the country many times since then for longer periods as i was studying back home.
Following are the dates I was in the USA
oct 02 to jan 03;
oct-03 to nov 03 (I got a re-entry permit(Aug 2004 - Aug2006) while in the first year of absence) ;
aug 2006 ---feb 2007;
jul 2007---dec-2007 ;
jan 2008 nov 2008;
18-jan 2009 – present.

So with all the information i got, i was advised that i will be able to apply under 4 years 1 day rule? as since aug 06 there are no trips longer than 6 months.
Is this true that i can apply under 4 year and 1 day?
I dont have tax filings for 2007, as i was supported by my husband (fiancee at that time), would it cause any issue?

any information here would be greatly appreciated.
Thanks

Yes, you can apply under 4 year +1 day rule. For 2007, you weren't required to file income tax due to lack of income, so you would tell IO this at interview.
