Can I-485 and I-140 be approved after interview in a local office?

Dear All,

My I-140 and I-485 were concurrently filed at Texas center in Jan. 2004. But both were transferred to a local office. My interview is scheduled next week. Is it possible for me to get my I-485 and I-140 approved at the interview?

If a visa number is available (ie. you are not EB3), then yes.

Thanks a lot for all the response.

TheRealCanadian, what do you mean by "if a visa number is available"? I am EB2 and working on EAD. I entered US on TN visa from Canada and kept my TN visa until I got my EAD. Does this mean that I don't have a visa number available? Can you please give me more explanation?

visa number for you is available. I think your GC will be approved after the interview. ;)

I140 is still not pending

Normally they transfer ur case after approving i-140
I am sure my I140 has not been approved yet. But my I140 and I485 were transferred in July 2004. My lawyer thinks that this transfer is a mistake and that maybe my I140 will be returned to Texas center when I go to the scheduled interview in the local office the next week.

While they don't normally process them, they certainly have the ability to approve them like any other USCIS office. My bet is that the I-140 and I-485 will both be approved at the interview.

Oh, that would be so great if you posted your experience and the results. Both of my cases have also been transfered to a local office. I-140 hasn't been approved yet. Very interested in the results of your interview.

My case is also transferred to dallas district office.

I have attended 485 interview on jan 11 2005.
On Aug 17 05 TSC transferred 140 to dist office and I am not sure dallas office will process 140 and waiting for the response from USCIS.

Interview experience

Dear All,

I attended interview in Charleston, SC last week. But it was almost a joke. I was told that my A# I had been using belonged to someone else. During the interview, I saw that my files were in another applicant's folder. What we did during the "interview" was to create a new folder for me. I was told that I would be given a new A#. My I-140 and I-485 would be returned to Texas Service Center for processing. In addition, to anwer my request for speeding up request, the officer told me that there was no way to speed up the process. In addition, I got no gurantee for exemption of further interview. Fortunately, I got a new A # in the weekend. But it took me almost 2 years to get a A#.

Hope no one will have similar experience.

About what? There's nothing that states that a local office cannot approve an I-140. If they don't feel comfortable doing so, then they don't.

I'm surprised that it wasn't approved, but this seems to be one of the few cases where a local office interview truly makes sense in an EB-485 case; there was an A# mixup and they needed to straighten it all out.
