Can H1-B visa holders start a Non-profit Organisation?

Hi,
Is it possible for a person or group of persons on H1-B to start a Non-profit organisation? I was reading this very interesting article by David Boswell from mozdev.org (for interested readers, http://www.oreillynet.com/lpt/a/5816 ), but was not sure if H1-B visa holders can do something similar.

Could someone please help clarify this,

All depends on the motive of the Org. Though sounds like charity, most of the non-profit org run as business, employ people - and do not show profit. If you are going to raise fund for any cause, you are liable to answer not only INS also all the local admin. H1 are not awarded for this purpose.

Thank you for the reply. The NPO would be concerned with Indian Classical Music and if it is legal, we would likely be raising funds for the cause. I will check the NY State laws if H1-B visa holders can start such an NPO.

I have been reading about this O-1 visa category which applies for people with extra-ordinary talent in Music or other forms of art like photography. Can such NPOs sponsor these visas?

Some of the O-1 no need of formal sponsership. They can petition self. Check with competent Attorney.
I know my contact attorney made one for well know South Indian Musician (Classical) in the year 1996

---------------------O-1 cant be self-filed it has to be sponsored or attorney acts as Agent. O-1 needs extraordinary achievement in the filed and documents for that achievement need to be provided with petition. H1 is not for everybody in Arts. other options are P1, P2, P3
