Can F1 apply for asylum in US without showing up at school?

i know someone who is coming on F1 student visa but doesn't want to go to school and instead stay few weeks and apply for asylum.


she doesn't have lot of money to afford the entire cost of the college and also she is a refugee and has lots of political fears.

Will not attending school first be a problem in her asylum case?

I think not showing up at the university means her F1 status is automatically cancelled by the USCIS as the school will report this to USCIS.

What's ur best suggestions?

she can't attend school and also apply asylum at same time.

Her school is at some other state and place where she will stay with freind and apply asylum is different.

The school will have to report her when she does not show up.

But every person who is inside the USA has the right to apply for asylum. She can go ahead and apply. The DHS will most likely believe that she deceived the visa officer when applied for her visa. But this probably will not result in denial of asylum.

I suggest that she retain a lawyer.
 
As pointed out she will likely become inadmissible/excludable based on the visa fraud. As long the asylum cases works out it should be ok (immigration fraud excludability doesn't apply for asylum-based permanent residency cases), but if it fails she will be bared for life from entering the US so get a good attorney.
 
what she should do? she should first report to university and than after sometime apply for asylum or just don't show up at the university and stay somewhere else and apply for asylum?

Will her asylum application be rejected and refered to court simple cos she doesn't go to the university?

She does have real persecution fear and past persecution and she is a refugee.

She is coming soon and doesn't know what to do.
 
3 words: get an attorney. Asylum is not a straight-forward process and it involves court proceedings. Get an attorney and follow his/her advise.

2) register for the first semester at school so you are in status. Most schools let you register and attend classes for an entire semester without paying the tuition - they just add 100$ or so every month to the amount due. The fees become a problem only at the beginning of next semester when they will ask you to clear your dues before registering for the next semester.
3) Apply for asylum towards the end of first semester through the attorney and this help reduce the chances of it being seemed visa fraud.

This is not a fact, just my opinion.
 
She wants to save the money she has to pay for school and instead wants to apply for asylum. The question is when she does it?

Her school is at different state and her place to stay to apply for asylum is in different state.

She may have to transfer school but wonder how fas it can be done?

I already commented on this. It is in theory possible but not very likely.

actually most schools have pretty early payment deadlines.

even if they do not you still have sooner or later to pay your tuition plus the fees incurred. the account will go to collection if unpaid.
 
have her go to school

for semeter and then apply for aslym coz like they said it will not look good for her more like she is copmmiting fraud

you could get on campus emplyment to help pay her her tution
 
Make sure to consult with a lawyer. There are certain limitation on when you can file for asylum after entering the country.
