Can anyone point me for the potential flaws in the procedure....

Hi all,

Company A has filed an H-1 under the advanced degree cap in July 2006 with the H-1 start date of Jan 2007 and I have not recieved its approval yet. I have been working for this company since a couple of months. Now I want to join a company B and they suggest me to take the folowing steps:

1. I should join them on my OPT that expires in jun 2007

2. Wait for the company A's H-1 approval and ask Company A to withdraw its application.

3. File for new H-1 from company B. They say that I will not be subjected to the quota issues as I was already approved an H-1 before.

The whole process seems nice but Could anyone please point me any potential flaws in the process. Are there any issues that I should be really worried about before considering this procedure???

I went through a lot of threads in the forums but nothing clarified this particular scenario.

But... Can I join Company B (without Company A withdraing my application) and have them file my H-1 again without going through the cap issues.
