wow, you are scaring me, uh no his mother did not became sitizen and he did not adopted him. So it doesn't matter that I have kids here and my husband work and no one to be with them? wow I don't want to go home and be without my kids, I don't know if I can handle this one, I have two little girls 1 is 6 years old and the little one is 19 months old. thank you for your opinion. :(
 
what do you mean? before we apply as a resident on july 2007. We apply for him to become sitizen and they denied because we didn't bring some papers of the court of when was arrested in fortlaudeale for license we went to the court house and they told us that because it was sooo long like more than 10 years the had destroy the files like they dont exist and we could get those papers and when he went to the interview they didnt say anything just send him a latter for low moral caracter and he was can of scare to push the issiue.
 
yes, it is more than 5 years, and we even have this clemency latter from the governor of miami but because we didn't bring this paper they ask from the court they denied him, and hi is sooooo hard head that I told him let's doit againg but with a lawyer this time and his responce is he wants to live it as last option because we are deep into this prcess now. Don't ask me what is wrong with him, he is just too close in his head lol.
 
Then he should reapply for citizenship now, bringing all the necessary documents with him. And probably bring a lawyer to the interview.
 
Jack - it's 5 years from the completion of the sentence, even if it is stayed, including probation. Also, the I/O is not required to overlook anything that happened beyond the the last five years - if they deem applicable, they can use the whole criminal history. I am sure you know that there was a time when N-400 asked for only the last 5-year criminal history, and now it asks for everything.

I don't mean to scare you or anything, but the ONLY chance you got right now is if your husband becomes a citizen. You can't do AOS, and you won't be given an immigrant visa if you want complete the process back home.
