Can a TN-1 be employed by a state or city government agency?

Hi,
I haven't had any luck finding any information on this issue. Is it possible for a TN-1 to be employed by a city or state government agency? I've found that for federal this is not allowed based on an executive order, but haven't found any info for state and city level.

There is no such proscription on the state or local level, other that if the same type of order was placed on those agencies by local politicians.

I even find this so-called executive order hard to believe at the federal level (if it does exist, I'm sure it would pply to all foreign temp workers, not just TN). Do you have the reference for this order?
 
I work at a state agency on TN. My mother used to work for a federal agency on TN. She's now on H1B with a pending I485 working for the same federal agency. Enough said?

I was referring to Executive Order 11935. (to clarify, I didn't mean to say it applies on to TN-1s)
 
So, as you no doubt saw, there are holes in that order that you can drive a truckload of foreign workers through.

I also know, through personal experience, that you can work under TN status for a state agency. I got mine at the consulate (I'm mexican), which is the equivalent (nearly) of a canadian getting it at the POE. Other than any agency rules or state laws, do you know of any federal rule that would prevent a state agency from petitioing a TNer through I-129?
