Brother applying GC for TN holder

Hi All,

This is my first post on this thread. First of all, I would like to thank the forum for great information on TN1.e

This is urgent!!! My brother is considering applying GC for me as he is US citizen. But I intend to work in the US on TN1 as I am searching for job nowdays sitting in cali. Would I be able to get TN after applying for GC?

Second question is I have done MBA from canada in finance and MS from US in engineering. I am looking for oppurunties in finance but this qualification or MBA is not posted among NAFTA qualifications for TN1? Is it possible to mould the letter or do something or show my MS degree but getting the MBA type job?

It depends what is meant by "applying for GC". Likely your brother can only submit an I-130 for you, and it will take several YEARS before you can use that I-130 to apply for citizenship.

This, the I-130 itself might not be a hindrance to getting TN, as it is not likely to lead to US citizenshipo anytime soon -- the wait is currently 10 years from submission of I-130.

You would be better off not bothering with I-130, and simply getting your own GC employer/sponsor.

Your MBA doesn't get you anywhere for TN, as you've found out. You need a JOB which falls under the TN categories (like accountant, or economist). Then you can see if your course load can be highlighted to demonstrate that you are eligible.

Not necessarily. As with I-140, it is simply one factor in assessing immig intent and does not guarantee TN rejection -- and I-485 is the real TN killer, not I-130/I-140. In fact, if consular processing was the option sought for GC, it definitely would NOT result in TN denial.

But, given the minimal value of filing I-130, I would not bother.
 
Let me be more blunt. An I-130 will not make it 'highly unlikely' that a TN would be issued. Just like I-140. TNs are issued with pending and approved I-140 all the time. An I-130, given that it will not be used to immigrate for several decades, is even less likely to impede TN.
 
Sure. I agree that you're statement was over-pessimistic, and that mine is over-optimistic.

But, to assist our poster rather than win arguments , my statement also came with the suggestion that it is better to focus on getting a TN and an EB sponsor rather than wasting time and introducing uncertainty in the TN process with an FB process, which would last for years unless he gets an EB sponsor.
 
Thanks nelsona and triple citizen for the so detailed answer. I agree not to waste time in GC through FB but rather TN1 to EB filing.
I have done few courses in accounting during the MBA program. Do you think if i get some job. I can insert ( if the employer ) that MS in engineering is preferable as I have done this degree from US. or is it difficult and they match the requirements in very detail.

I understand that many H1 visa holders losing jobs and been forced to move back to home countries. What is your opinion whether it would be easy for TN1 to get the jobs and then the visa as there would be less competition?

TN is obviously simplr and quicker. Your degree has to match your job for tN. You can't get anaccounting job with Engr degree nor vice versa.
