Bring husband to US after received Green Card

Hi Friends I need some help:

I am a permanent resident, in US, I back to my country after received my GC, because my company is doing a transfer for me, taking advantage of my condition as perm. resident, to work in US.

I am planning get married with my boyfriedn before I leave my country (he was my boyfriend before I became in perm resident), we work together, that is why we could get married before, but now I am going to be transfer to US and we have decided get married but we don`t know how long will take until he can go there, as my husband

What we can do??, maybe be many of you could tell me that I should have married as soon as I received the notification letter, but we wont that anyone of us lose our job if we got married (imposible being married and work together for this company specially in same area of work), at the end receiving the immigrant visa is not sure until the interview day.

As far as i know ,It will take about half a decade for you to be able to obtain a green card for him to migrate to be with you but i believe you can rather use your permanent status to obtain a non-immigrant visa for him with which he can visit you frequently.In the meantime he wouldn't have to show any immigrant intent in order for him to be able to apply for a working visa if he qualifies through any of the categories after sometime.Better still he should also keep trying his luck every year within the five year waiting time to see if he can win the Lottery as well.Marrying just after receiving the NL is not always a perfect plan as it could also have other repercussion.This is just my opinion and i hope no one misconstrues me.You have the option to take it or leave it.

It will take 5+ years, unless he is from Mexico.
you have to file I-130 first, and once PD becomes current, he can file I485 or immigrant visa, but PD won't be current anytime soon as FB category is much oversbcribed. 5 years is probably minimum time, whether you file the petition as the permanent resident or US citizen(if you choose so).
 
Thank you all of you for your advices, I was thinking it would be easier, I think we have to take a decition, right know, but whay it will take +/- 5 years, why this process is so long??

Because FB2A category is oversubscribed like other FB category. Visa number is not available for all of them currently petitioned.
 
Excuse me GotPR, but what is FB2A, what you mean is that it takes time because there are other cases before mine??
 
it takes long because you are not a US citizen (so that is the official waiting time period for a resident to bring a spouse I think the category is 2A), another way would be for you to wait untill you became US CITIZEN (5 years of being a "resident" in the US", and the backlog in the paperwork is about 1 more year depending on the state where you choose to live at), an then get him his residency trough once again the form I130. I guess the only way is that he can apply for a tourist visa and live here 6 months with you and you can go back to live 6 months with him over in your country (that way you will get to keep your greencard also), but is very complicated because it becames harder to settle in in america by going back and forward.
 
F2A is category for spouse and children of permanent residents.

You are in the F2A line waiting for trains. Train pulls into station, but it can only carry 110,000+ passengres. Once the train is filled by that many people, the train leaves and the next train won't come til next year. Til you advance to the point that you can secure the seat on the train, you have to wait for that many years. There are about 600,000 people waiting before you.
 
FB2A meand SECOND PREFERENCE CATEGORY A SUBCATEGORY AND FB is FAMILY BASED petition, chek the latest visa bulletin from the state department for a better understanding of categories and processing times
 
I am in this boat they are talking about. I have been waiting for years for my husband to join us, but it has taken forever but luckily for me i becos a citizen by the end of this year, so i am almost there. Once you have a pending case, they wont give him visa to come, I tried that but they refused him. Trust me it wasn't easy but i did it. Keep playing the lottery for him, you never know. My husband actually won the lottery but he had a high number. You can go visit him too. Good luck in your decision.
