Also, if your I-485 keeps you in valid status, how long can you be in that valid status?
-------------- you will be in Pending AOS status till your I-485 gets approved or denied

What if the break in job is say, 2 months?

Thanks.

Is it OK if the permanant offer is from my friend's consulting company ?

Another question Ginnu/RealCanadian please help

I'm in a situation for which I need some help.

I worked with a company that applied for my LC, I-140 and I-485. I-145 was applied in July, and I still don't even have the receipt notice.

My position in the abovementioned company was eliminated on 4th Sep.

One paystub was issued 6th Sep, and I believe since I worked 2 more days in the last pay cycle, I'll get another paystub on 20th, though that would be for working 2 days only.

Now it took me a while to find another job, and going by the onsite interviews I am taking, it appears that I should be able to file for an H1B transfer by the end of next week.

That would make it almost 3 weeks break between jobs - just about a week if you consider the (incomplete) last paystub of 20th Sep.

Also, although my H1B started in Nov 2003, I had joined this company in 2004 and so my H1B was valid till end Oct 2007. But in July I got a 3-year extension on my H1B because of the approved I-140. So my H1B is now till Oct 2010, but the I-797A, notice of action mentions "Valid from Oct 2007 to Oct 2010".

Now the questions:
1. Is the last paystub date important, when doing an H1B transfer? Or the number of days worked on last paystub still works against me?

2. When I do the H1B transfer, I am no longer with the company that sponsored that I-140. In that case, till what time do I get the I-94 from the H-1B? Would it still be Oct 2010?

Are there things I need to take care of? What are my options?

Thanks for the help.

Urgent Question

Hi Gurus, Ginnu and Canadian,

Soon my 180 days will be over and can change job by using AC21.
My basic question it seems I have to work for my GC sponsoring employer once I get my GC.
So assume I get my GC in 1 yr and during this period I work with some company X or say my own then after getting GC do I have to go back and work with my GC sponsoring employer??
During this 1yr can I own the company or work for a company which my spouse owns and still in good standing till 485 is approved??

Thanks again.
