I'm about to join a company which is processing my labor. Once the labor is approved, I will join the company. How long do I have to wait for applying the 140 & 485 after joining. Do I have to wait to submit the paystubs for few weeks? If I apply immediately without any paystubs, does it have any effect on the applications. Please let me know.

Has the NH SESA Stopped processing all applications NOV 2003 onwards ? I have not seen the dates move for the last 6-7 months. Anybody know the number to call for NH SESA office ?
And again please somebody tell me how to start a separate thread (sticky) thread. There is none for New Hampshire SESA tracker. Is there anybody here who is waiting on the NH SESA or all you guys jumped ship, if you did tell me to which one. I will jump too.

Infact I noticed that the dates moved back for Non-rir. Last month it said processing 11/12 2003and now it says 10 2003.
The NH SESA number is (603) 228-4083.
Please keep us posted about any updates.
And I think we should start a tracker for NH SESA.

There is Definately something wrong with NH SESA. I am fearing that it is going the Delaware way.
We really need to find out if everyone is having same problems or its just me.

As far as new thread for NH is concerned, seems no one here knows how to start a sticky thread, there are about half a dozen non-sticky going around that get lost.

Do we ask the administrators to start a sticky thread ? As there dont seem to be an option for a regular user to do that.

MA SESA RD: 06/09/03
Forward to BOS DOL: around 04/28/04
BOS DOL RD: 05/05/04

H1 6 years expiring - but visa granted for more than 6 years

Hi All,

I know this is not the relevant thread for this topic, but I thought I might get some insights from folks here.

My H1 started in Oct '98, but when I changed jobs later and got it transferred, the visa was granted until July 2005, past the 6 year limit (which will be Oct '04).

My lawyer says that since it is USCIS's mistake, they're responsible, and so my H-1 will be infact valid until Jul 2005. Is this true? So, the lawyer says, we can wait until next year to file the 7th-year extension (based on pending GC).

Has anyone been in a similar situation or know what applies here? Or how to fix the problem?

Any input/insight would be really appreciated!

What your Lawyer says is wrong.
We had the similar situation. My I-797 had validity till Jun2004 but my 6yr expired on Sep 2003. It is a mistake on the Lawyer . Generally why this happens instead of asking H1 transfer while joining a different comapny they request for a new H1. So the INs gives for 21/2 to 3 yrs.
It is our responsibility to make sure that u extend your visa after 6 yr expires.
I applied for exension based on LC and got aproved for 1 yr too. So you have to apply for extension and dont stay with the existing visa.

Thank you very much for the reply! This is what I suspected too.

Could you tell me which month you applied for the 7th-year extension? Did you do premium processing? I wonder if I could apply, say in June and just do regular processing. It seems to be taking 7-8 months now ... so I wont get it possibly until Jan 2005 or so, although my current H1 expires in Oct 2004 ...would that be a problem?

We had some other issue also. Intially I was not eligible for 7th yr extension as my LC was applied before 11 months only and it should be applied b4 1 yr for 7th yr extension. But I had gone to Italy for a month in 1999. So they captured that timeperiod and applied for 1 month visa. After that got approved they applied for 7th yr extension in premium processing. Better to go for Premium processing.

Have u applied for 140/485??? Do u require W2's ? My lawyer did not ask.

I just mailed out my I-140. Lawyer said W-2s are not necessary as my company is a startup and has VC funding (no revenue generation yet). I just sent my last 2 paystubs, along with employer letter about amount of VC funding received.

Last RIR Approval from DOL-Boston ?

Hi Guys,

Can some one tell when was the last RIR case approved by DOL-Boston ? I mean the date when it was forwarded to DOL-Boston.....

Mine is May 7.

RIR at DOL-Boston

Mine went to DOL-Boston on May 7, 2004. Its an RIR case transferred from NH state.

neocor - NH SESA is usually pretty quick. what processing dates are they on currently? If it's within a month or so of your date, you might hear soon about your non-RIR case. I _think_ the RIR requirements are quite stringent for several new england states, so you might want to make sure you've a strong application before converting to RIR (talk to your lawyer for assessing this).

The Processing dates for NH SESA Non-RIR currently show Oct 03, and they have been that way since I applied in Dec 2003. That is why i was wondering if something happened there ? The Dates were moving pretty fast just before I applied (it used to be just one month behind). But seems it has suddenly stopped in its tracks.
Is it safe to call the NH SESA office to find out ? Has anybody called there ?
