Bongo Finally Got Through to an IIO, thank God

It doesn\'t matter if the IIO finds out if you have a H1 transfer
in the works.

If you AOS has been pending for more than 180 days, before
you filed for the transfer then your fine.

My attorney is still hell bent on telling the INS I changed
jobs. I\'m hoping I\'ll get approved (very slim chance) in
the next week or so and this won\'t be an issue.

If I don\'t get approved, I will tell the INS and send
a nice letter to them from my new employer saying how
similar the new jobs are.

I think by filing the new employer letter AND the letter
saying your changing jobs, you reduce the risk of
an RFE.

Bongo I think it is really good idea to wait and see.
If you are lucky you may get to approval without rfe at the most what will happen you will get rfe which can be replied.
 
Guys, I have a question....

What happens when someone gets laid off by the time of 485 approval?
What if there is not much time between the time of layoff and the approval date to find a new job?

My attorney says that as you are adjusting status, you
will not be out of status because your current status
is that of an "Adjustee".

As to the time between jobs. I have a 45 day gap and
attorney seems OK with that. They are a conservative
attorney.

What if I can\'t find a new similary job by the time 485 gets approved?(after 6months)

We have exchanged messages on the board recently. I am glad that you are getting close to a decision and I wish you good luck. As for whether to inform INS or not, I don\'t think there is good or bad thing to do or to judge. As I know, in certain cases the INS is informed of a change of somebody\'s employment, and if the officer is required to check on it, they will find out. For example, if a company acquires another company, they may inform the INS that they are successor-of-interest to the acquired company and they are taking over the immigration libility for H-1B holders. I do not know whether they will identify each individuals though. Put that aside, I agree with ProActive who posted a related message about 10 days ago on that waiting for the RFE to come maybe a waste of time if the applicant does get a RFE. It seems to me the INS is sending a lot of RFE\'s lately. So it\'s a matter of judgment. I personally believe to inform the INS is a safe thing to do.

Any way, I hope you get approval soon.
 
What was your finger print appointment center?

Guys,

Using the 180 day rule is a grey area of the law.

Your suppose to inform the INS of change of jobs
as soon as your intention to work for the company
sponsoring the I140 changes.

My lawyer will send a letter saying I\'m changing a job
and also a letter from new company saying title of new
job, salary and duties (as per INS memo). I think by
sending these two letters we will reduce the chance
of an RFE.

Regarding, what happens if you get your I485 approval
between jobs. My attorneys said this happened a few times
to their clients. The clients wanted to come clean with
the INS, and inform them via their lawyers. The lawyers got
a letter back from the INS saying to leave the applicants
alone, they already have their GC! I think the INS thought
the attorney (who are hired by the company) were trying
to get the applicants GC taken away!

FP Question - Bongo

Hi Bongo
   When you checked your FP status with IIO, did he/she was able to give you info just using you WAC#. When i called them she asked me A# to check FP. Also my AVM still says old message "FP sent.." haven\'t got updated to "FP Received.." seems like AVM changes after moving FP from system 1 to system 2. Please share your thoughts.

Does the AVM say that "finger print request was sent out" once it is sent to us?
