Birth certificate of a sibling

I need to apply I-130 for my brother, who doesn't have a formal birth certificate with our parents name on it. In earlier days, 10th class certificate was used as a birth certificate for all formal purposes in India.

But US immigration needs a formal birth certificate for the I-130 application. Can somebody please suggest us ways to get the birth certificate for my brother in India that is acceptable for submission with the I-130 application.

My friend, India is a corrupt enough nation for you to 'buy' a birth certificate, appease USCIS and get your brother here. If you have family members back home I am confident someone knows someone who may know someone who can assist. I am being very honest in my response; this is not sarcasm!!

Here's what you need to do.
a) Get a letter/statement from the Municipality that "Birth records do not exisit"
b) Have both parents write Affidavits - affirming to the birth of your brother (identifying him by name, and stating his DoB). The affidavit should also add that he was not born in a hospital, or that his birth was not registered (whichever the case might be).

Send a), and b) to USCIS - who'll accept in lieu of the BC.

Excuse me, you're not an Indian, are you? Ask me abt India (any part of India), and I'll tell ya! For starters, you're plain wrong in yr statement (most likely) based on hear-say...

Advising to buy a fake birth certificate is poor judgment.

If someone never had a birth certificate, they must obtain a letter from the foreign government official indicating that a birth certificate was never issued, along with a sworn statement from parents (or family) who can attest to hsi identity.

I don't know about I-130 but it is well established practice the USCIS
accept various kinds of substitutes for birth certificate during I485
process. A typical approach is to find a notary agency that create a notorized documents state birth date/place parent names etc
