Birth Certificate for I485

mY bIRTH certificate from the municipilaty does not have my name on it . i have been asked to get an affidavit from my parents . will that suffice .pls suggest
 
I think so. My wife recently got an RFE for same reason. They asked to provide two affidavits. You can provide your school certificate alongwith affidavits too. Birth certificate (with no name) + 2 affidavits + school certificate should be sufficient.
Or if you have time, you can always go back to municipality with your no-name-certificate and request them to provide a new certificate with name on it.

-------- On stamp paper of 10 rupees get the 2 different affidavits from parents or elder relatives that should state your name (as on I-485 and passport) date of birth, place of birth, parents name. Go to www.immihelp.com and look for sample documents. also get non availability certificate from municipality and get it translated in English(if not in English) from notary or any one can do it the translation in US

According to my attorney non-availability certificate is not required for this kind of cases. That is contradictory because you have a birth certificate. Basically you have two options

1. Two affidavits + non-availability certificate (and don't provide the certificate with no name)
2. Two affidavits + birth certificate with non-name

Affidavit is whatever ginnu explained in earlier post. A confirmation by your parents/relatives about your date of birth. See this link:

Normally USCIS asks for atleast two affidavits. They can be one from your father and one from your mother. Other relatives - uncles, aunts, grandma, grandpa can provide affidavits too.

I have a situation where my wife's date of birth registerd in Muncipality is months later than in records. I am planning to get the non-availabilty certificate. what should the content be,

nd 09/13/2002
FP1 10/08/2002
FP2 06/22/2004
RFE 10/19/2004 DOB for wife and me and marriage certificate for wife.

Please help!!!

-------- search for xyz birth record was done for year...... and her(name) birth is not recorded or birth record in not available. that will be in indian language frommunicipality then get it translated in english fron notary on 10 rupees stamp paper and notry will put his deal on translated paper as true translation

Hi Gurus,
I need to know, if any one has a different Last Name in Birth Certificate and Passport, but same first name. Will BCIS will accept it for I485 it with an affidavit, if yes, will this person will get the last name from Passport or Birth Certificate.

name, last name as on passport should be SAME as on birth certifice or affidevits

That depends, if the person's last name changed after marriage - her passport and birth certificate last names will differ for obvious reason. Other possibilities are - changing last name on his/her own (provided he/she has enough legal documents for that). And these cases are accepted by USCIS. You need to explain why that person's last name is different.
That person's green card will issued with name that he/she filled up on I485 form.

Ginnu, basically these guys at the muncipailty searched for one year before the date of birth in passport and one year after the date of birth in that they found this discrepancy date of birth and are not giving as per the date in the passport but the real one. Which obviously will not serve our green card purpose.

I am totally confused and very much in tension.

Actually, he got a birth certificate from India with different last name than his passport one, no marriage yet.

Is it just spelling mistake or totally different name? Like "Sharma" instead of "Kapur"? If it's totally different name, then his/her BC is NOT going to work. It will look like he is using someone else's birth certificate. Either he/she has to obtain birth certificate with corrected name or get affidavits from his/her parents/relatives.

In that case I would recommand to submit with that birth certificate (with incorrect spelling). Meanwhile, you can get a new certificate with corrected spelling for any possible RFE in future.
