Hi,
I came here 8 years ago with B1 visa, since then i never went back to My country. I don't have work permit or GC also I never applied for GC. Now I have one child and all my familly are here. do you think applying for green card now would be a problem?


please please please help me??? I am really desperate

Hi,

Yes you have a problem, you are an overstay and depending how long you have overstayed then you will be subject to a 3 to 10 year ban from entering the usa

Even if your child was born in the USA the child cannot sponcer you for green card until 21years of age


Have others got any advise, in case I have missed something
 
Is your spouse (assuming you have one) a US citizen?
