Hello all.
I had my interview on the 14th, and last week I found out that I have to appear in the immigration court on the March 20th. I have till Monday to come up with the decision on the lawyer, or just in general do I have the strength and patienced to continue.
Does anyone know, if I will decide to leave US, do they put a special stamp in your passport when you leave?? and how this whole situation will affect getting visas to other contries?? in particular UK... Please guys im all spaced out this past few days... just any infor if you know
thanks a million

You were fingerprinted so you record is in U.S Databases. The only countries that share "immigration" info with other country is Canada so you may have trouble getting a visa to canada...However, UK is ok I think and you just need to make sure you can be approved for a visa.

Opell; Don't give up yet. They are giving you a second chance by sending you to immigration court. That means you still have a chance. Go to court and fight for your rights. Good Luck.

Thank you for the info :))
I was just thinking of going back to UK to finish my MBA dissertation. And logically speaking, I didnt see any problems with getting the visa there. Since that will not be the first time

Gracias, pero no tengo la paciencia. Puedo ver que los Estados Unidos no me gustan :PP po eso no pienso que puedo quedarme aqui... Lo siento por los errores... no soy espanola, soy rusa :)))

Don't give up! My application was also denied during the interview but in about 5 months my asylum was granted by IJ. Do you know what the reason for denial is?

Your spanish is good, no errors. But I still think you should go to court and fight. This is a country with lots of opportunities.

Whatever you do, I wish you luck.

Hi.
The reason was Lack of details. Don't ask. I have my hearing on the 20th March. But as far as I know I will have at least 2 or 3 hearings. How many did you have?? and how in general that whole thing went at court??

On March 20 the judge will ask you if you have a lawyer and if you want to continue the case. If you or your lawyer says yes the judge will give you a new and final date to come back where you will be asked questions by a fiscal and your lawyer (if neccesary) then the judge will decide to give you asylum or not.

dear OPELL:

I was denied bt the immigration officer, then

denied by the immigration judge, then

I WON ON AN APPEAL .

DONT GIVE UP

There have been many many people who were rejected in the asylum office for different stupid reasons but got approved in the court, the circuit court, BIA,... there are many ways to appeal. Don't give up. Hire a good lawyer or if you can't afford it try to get a good pro bono asylum lawyer and fight.

Hello everyone

Thank you SO much for your support. You guys have no idea how much your posts mean to me. THANK YOU!!
I just found out today that even if I will decide to give up and leave, I will still need to go to the court in order to close my case.
Question: for the first hearing, which is technically is not a real hearing, do I need to come with the lawyer??

If in your heart you feel that you have a valid asylum case I suggest that you keep going with the process. There are many people who are now well established in the United States who did not succeed on their first try with the Asylum Office.

Don't give up hope. In January I along with my brother was granted asylum from immigration court. I was caught when immigration officers raided my home looking for my brother. They were tipped off by his college. My brother was not confident with the asylum case but I was and so we decided to take our chance in Court.

The whole court process took about one year for us. We are located in New York City. Yes you have to appear before the judge even if you want to go back home. In one of our hearing, we were late by twenty minutes and the judge had already issued an arrest warrant for us which he later cancelled. All in all we had four hearings. In the first hearing, the judge asked us what we wanted to do. We said we wanted to apply for asylum. We were given another date five months later to submit our application and all supporting documents. After that we received another date four months later for our interview. We were cross-examined for two and a half hours. After that we were called two months later and we received our decision.

I don't know how knowledgeable the immigration officers as I have never dealt with them. are but I found my immigration judge to be very knowledgeable and also very helpful as I fought my case without a lawyer. The DHS attorney was not very knowledgeable in my case and because of that during the cross-examination he was not able to counter my answers or questions and because of that he lost the case.

This might also help you. During the first and second hearing, the court will be full of people. On our first hearing, there was this person, who wanted to go back home. The judge told him that if you leave the country within a specified date and you pay for your plane ticket, in future you can apply for U.S. visa and you get it, you can visit the country. On the otherhand, if the U.S Govt pays for the plane ticket, you cannot come to the U.S. for the next ten years.

Hope this helps. My suggestion is to go to court and fight your case. Nobody knows what the future holds. DON'T MISS YOUR COURT HEARINGS. IF YOU MISS, NOTIFY THE COURT IMMEADIATELY OTHER WISE YOU WILL BECOME A FUGITIVE.

Certainly go for it! The process is pretty straightforward. You will have first hearing on March,20 where you will introduce your attorney to the judge and the judge will schedule the main hearing (in my case it was 3 months after the master hearing). Then you show up on the date he or she will tell you and that's when all the fun part begins. My court lasted 4 hours during which I was crossed-examined by the judge and the prosecutor. At the end the judge will tell about his or her decision. That's pretty much it. Best luck to you!
