i've been asked by my italian company to move to our american branch for a couple of years. I'm not sure about what kind of working visa i'll be on. anyway the question is how i can bring my partner along with me.we're a gay couple. I read about the b2 partner visa. How does this work? we haven't ever lived together so we don't have any bills or anything else to show that. Do we have any chance?
What other chance do we have?
Is there any way for him to come along with a tourist visa and change it in a working visa once is there?
He works in fitness as instructor, is it a field requested in newyork?
I need to evaluate everything before accepting this offer.
It's urgent.
Thanks to everyone who can help.

I am aware of this, however my first post still holds validity. There is no visa called "B-2 partner visa". There are cases where a B-2 visa may be issued to a same sex partner of a long term non-immigrant visa holder. However if you go into the details of it, there is a criteria that must be met. Your first post indicated you both have never lived together. So it is a moot point. Thus I suggested H-1B.

What's this then?
Have a look at: travel.state.gov/visa/laws/telegrams/telegrams_1414.html

thanks for your replies.
I know that we've never lived permanently together but we've been a real couple for 3 years. we've shared all our weekends and holidays and lots of time together. He really would follow me because he wants to live with me and this separation would cause a split-up between us. I read that there are not specific criteria to meet but the most depends on what the consolate thinks of you during the interview. Moreover he's only 24 years old.
What if we try to get the b2 visitor visa for cohabitant and then we're rejected, would he be offered a normal b2 visa for turist 6 months long or he'd need to go for another interview etc.? Do we have chance to get a 6 moths visa for him or they usually give you a 3 months visa?
What should we prove or try to show if we apply for a b2 cohabitant visa?

Try to gather all documentation that shows your three year old relationship and then apply for his B-2 visa. See if you can convince the consul. In addition to that, your partner will also need to show strong ties to Italy.

gay marriage

hi,
Seen the recent law in New york which allows the gay marriage, is it a way to let my partner stay in new york and get a visa along with mine? Getting married there could it be of any help?
Thanks for the reply

USCIS is a federal agency. What has happened in NY state has no bearing on USCIS, yet. As suggested earlier, document your relationship and see if you can convince the consul to issue your partner a visa.
