Hi all,

I am a software engineer.

My petition for a non-immigrant worker (H1B visa filled by new US employer) is in approved state.
Now, visa stamping is pending.

However, my current employer wants me to travel to USA for 3 months on B1 visa.
And is also going to apply B1 visa application in couple of days.

I request you to please answer following queries at the earliest.

1. Will I be granted B1 visa, when H1B visa process is still going on.
Please note that US employer (who has filled H1B visa) and current employer (who is going to file B1 visa application) are different.

Hope to hear from you as early as possible.

Regards.

No "employer" can file a B-1 for you. You as an individual applicant will apply for and qualify (or not) on your own.

Thanks Mr. Ghori for your reply.
So, does that mean, if H1B process takes 3 to 4 months, then you can not travel to US on B1 during that time.

Are there any ways out?
I need to apply B1 since my current company wants me to go US. And I cant say no.
Also, I dont want them to know that I have applied for H1B...:-(

Please help me.

Ok...so what are the chances of getting B1 visa if at all I go for an interview?
Please let me know if you foresee any problems?

Unfortunately no one can produce those statistics for you. It all boils down to one variable, the interviewing consul. Good luck!!!

Got your point sir...I thought, you are not allowed to file B1 at first place when you have approved H1B prtition in your pocket.
But now atleast I can apply for B1.

Please let me know

1. Applying B1 will not affect my H1 process. right?

2. Do probabilties of getting B1 reduce because of approved I-129?

your quick reply is really appreciated...

A1: Should not, but no one can guarantee that it will not have an affect
A2: Your I-129 is already approved, right?
