I e-mailed a question regarding 485 RFEs issued before reterogressions and about further processing of 485 to shihab.net.

The answer is as follows---The real question is this: was an immigrant visa available to you (meaning that your priority date was current) on the date that your I-140 was approved? If the answer is yes, then the retrogression will not stop the USCIS from approving the I-485.

I hope this will be true in reality

davana2004: thanks for your input regarding retrogression. I guess there are lot of people, including me, who's bothered by this issue. Hope its true what you found about availability of visa numbers.
 
I have been watching the trend for quite some time now & have almost reached a conclusion that my case has been affected by retrogression.I receive an RFE in dec which they received from me on 6th Jan .My dates changed for a few days thenstoppedon 11th nothing after that.

hope am wrong..
 
I think we are affected by retrogression and if the RFE reply did not reach NSC by Jan 30th our casee come under retrogression.
Hope I am wrong.

i got an email update regarding the receipt of my RFE response.

following is my detail

PD: 8/2002, RD : 2/2003, ND- 2/2003
1st RFE received : 12/23/04 - medical
2nd RFE received 01/10/05 - same as above !!!!

RFE response received by USCIS : 01/26
LUD change 01/26

does any one know how long it takes for an approval after the receipt of RFE response by USCIS
 
I-485 Adjustication after RFE

I believe per I-485 SOP, retrogress will affect us. Mine PD was Oct2002,485 RD April2003,RFE received by USCIS on Dec22nd. AFter that no change.

Recommended Approvals

When to
Perform
Once an I-485 application has been adjudicated, and the adjudicator deems it
ready for approval, the adjudicator should follow the “Recommended
Approvals” process.

Description If an adjudicator finds that the I-485 application is ready for approval, he/she
indicates that the case is "Recommended for Approval" and sends a sheet to
INS clerical or the contractor requesting a visa. INS clerical or the contractor
contacts the Department of State (DOS) to verify that a visa is currently
available. Once DOS verifies that a visa is available the clerk will route the
case back to the adjudicator. The adjudicator will approve the case and send
it back to INS clerical or the contractor for card production activities. (If the
adjudicating officer faxes the visa request to DOS directly, the file will be
routed to INS clerical or the contractor for card production activities after
he/she has approved the case.)

Procedure Complete the following steps to determine if the visa is available.

Step Action: INS/Contractor
1 Receive the files for visa requests.
2 Fax or email the list of all visa requests to the Department of State.
3 Once responses are returned, copy the list and return it along with
the files to the appropriate adjudicator.
4 Once approved and returned from the adjudicator, RAFACS and
forward the files back to the adjudicator.

RFE issued : 12/30/04 - Secondary evidence for birth----

RFE response received by USCIS : 01/26
LUD change 01/26

Hope USCIS will process our files.

SOP reading doesnt support our hope, but lets hope
 
Per USCIS site, my case is approved. I have not received email (I dont know whether its an anomoly ??).

They have taken only 3 days to approve after receiving RFE. I dont know whether this is normal behavior. I will update the spreadsheet after receiving the approval mail.


EDIT : Received email from USCIS. Updated the spreadsheet.

Thanks every one for your support. I wish every one will get approved in the next few days.

LUD changed today

Did any one's LUD changed today for the following pattern:

RFE response received : 01/20
and then LUDs : 01/20,01/21 and 01/24.

LUD pattern

Well the LUD pattern of
1/20, 1/21, 1/24, 1/27 seems to be continuing. I hope we will hear the good news soon but don't know how soon.

Frequent LUD changes is good sign.

MY RFE was about employment letter. I sent the employment letter from my current employer on 01/19/2005 and was received by USCIS on 01/20/2005.

Mine is AC21 case.

my LUD update pattern is exactly the same as you guys.

ie. 01/20, 01/21, 01/24, 01/27

but that doesnt mean anything much because anotherhawkeye had the same pattern but got approved on 26th.

me and wife had birth certificate RFEs. I am on EB2 and filed 485 Oct 2003.
