My employer got the letter today, NOF is about the salary & advertisements something is not clear in the documentation.

SESA: Sept 2002
DOL Recieved date: 16-May-2003
NOF issued: 20-Sep-2004

NOF is not that bad as it sounds. Normally they are not that complicated to handle but it causes delay in approval.

I had a similar NOF issued by Philly regional DOL back in Nov 2002. It was about adv. (missing tier-sheets) and LC got approved within a month of rebuttal.

Regarding salary, I would say increase it to whatever amount DOL is looking for, if employer is OK with that.

Thanks for your replies. No additional updates so far. I did check the AVM and it did not specify any expected timeframe for the response. Will call DOL to confirm.

EB3 Category dates retrogressing

Hi,
I apologize in advance if this is not the right forum to post this question, please advise which forum I should post this question?
I am very concerned with the news of EB3 category dates retrogressing. Although, I am still waiting for my labor certification to be approved. I am afraid with this retrogression I may not have any where to go after labor cert approval. Since, I probably will be one of the EB3 category applicant, does it mean that I wont be able to file I485 cos of the unavailability of visa numbers, and consequently I cant take advantage of concurrent filing?
Also, does it also mean that I wont be able to apply for EADs for me and my spouse?
Will I have to give up my employment since my H time will be expired by then as well?

All these visa numbers not available for EB3 applicants after Jan 2005 is all in news and also in this forum. Since labor has past 1 year from Priority date, you company should be able to extend beyond 6 yrs limit on your H1 , even if your labor is approved. This is the answer i got for the question posted same as yours.

how to track State labor certification. My application received by DOL, Atlanta on June 5th but i dont know what is the status. I am relatively new to this forum.

What is all this EB3 backlog about...sorry for being so ignorant..but what would be our fate in this situation..i mean for example, my RRO June 2, 2003 not being processed yet and it is late september now..what do you all think about people waiting for LC hereafter would face????????????????
would appreciate anyone explaining this backlog story in layman terms..

First of all..thanks buddy( Some Greencard)..for posting the link. Greattttttttttttttttt.can our life get any more worse???..pathetic..the light at the end of the tunnel is nothing but an oasis in the dessert. Let us start praying..only god can help us.
 
"if you've already applied for 485 but your PD ain't current you should still be able to live in the US. But EB3 folks whose PD ain't current will have to leave the US or get on to another visa bandwagon". This will SUCK!!

I am wondering what will happen to the 7th H1-B extn for the applicants whose PD not being current?
 
if you have master/Ph.D. degree, you can go through EB2.
all depend on the ad.
if ad. required at least master degree, you should have no problem
 
EB3 Category question

Does the EB3 category effect everyone from all the countries equally?
I read somewhere that if you are not from india, china or phillipines, you dont need to worry?
Can anyone please comment on that?

It effects mostly indians, chinese due to the number of applicants is compartively more than other countries..
