Atlanta Regional DOL Tracker

I was just told yesterday by my dumbass attorney that I had received the 45 days letter back on April 7th and that they had signed it on my behalf and sent it back to Philly :mad:

I don't know which date is what, but I submitted my LC application back in Aug 2003, got a notice saying that it cleared state and went to regional in Oct 2003 and since then nothing... until now, when I heard about the 45 day letter.

Anyone in here who got their LC approved after getting the 45 day letter? If so, when did you application go to the regional office in TX?

Even i got my 45 letter in feb, my case also went in aug2003 to regional, i had querry with 45 day letter about my company has moved and they need some documentation, we sent it but so far no response and no approvals, iam daily in touch with my attorney.
 
Me Also Kasid, Reply 45 Days Letter, but nothing came back yet, Did your Attroney gets any approval from Philly BPC?

Iam happy to see somebody is alive in this thread...No..no updates on 45 days letter...
In Philly BEC thread...most of them are so frustrated ...Dallas BEC rocks..bad luck of us...

Guys,
I called my lawyer, he told me that they dont have any new 45 days letter,
they used to get atleast 2 per week now not even one per week.
They don't have any system to check the status of 45 days letter, its been a while now, i really dont know whats going on with this folks at philly,
I think everyone are on a vacation for a month or so..
Like "God bless America"
we should start saying "God bless immigrants"

I think there ultimate plan is to send all of us back to our home countries..
Well that's good if they dont want us here, our home country is welcoming us not a problem...............there is a proverb "what ever happens, it happens for good itseems" we should always think in this way and then it will help us...

Checked the Philly BEC tracker and us (from Atlanta) are the ones with the least amount of 45-d letters received. As a matter of fact, the last one received by someone in Atlanta DOL was beginning of May. What's going on with people transferred from Atlanta Regional?. People from Philly Regional are saying they are processing (about to certify) casses of April 2002. So, it seems those coming from other Regional Centers are not priority......who said something about a FIFO?.........it is a very biased FIFO if you asked me..........
Can someone share a ray of light on this 45-d letter trend?........me and those without a letter are still in the limbo (a box somewhere), that is pretty scary. Let's keep our hope..........................for another while.

Hey thanks buddy, but shall i tell you one thing, its better not to get 45 days letter because after getting one and responding it and if you find more delays in response and if there is nothing to check the status and it makes you more tensions and it will create lot of problems, my lawyer sent the required documentations for the query what they asked for address proof and company registration documents with the response. But still now no news at all, this makes you more crazy,

Hey i want to check my status can you guys help me which address i should send it and to whom i should call, to find the status of my letter atleast then they might open my file and do something.

When can i do my 7th year extenstion, my visa is going to expire on Aug 2006
and I am going to india in sep 2005 and iam also going to consulate for stamping (chennai), i hope everything will go smoothly over there.

I heard that we should ask for 7th year extention only before 3 moths of your expiration date is that true?
guys not even a single case has been approved from atlanta recently, i dont know when will they start approving.............

Kasid,

You can apply your 7th yr ext. prior six month, you can apply on March 2006, for the pending Labor proof you can use your 45 day letter if you received, if not, search dol website or some thread, have email address, where you can request, they will send you screen shot of their system, uscis confirm that they accept as a proof.

2 approvals from PBEC

Hi All,

I read in Phili backlog center , that 2 cases TR 's which are transferred to PBEC from Atlanta DOL with priority date of June 2003 were approved.

Not sure if they received 45 days letters or not.

Any one in this forum received an updates?

Mine also Jul 2003 from atlanta fwd to Philly, i havent received 45 days letter...this makes me more worried..

Sorry i have no furthur information on the case. The only information is , that i read in the forum posting by tracker_chicago.

My case went to Atlanta DOl on August 8th. I didn't receive my 45 day letter yet. I am worried too.

I think Kasid's case also went to Atl DOL in August and he received the 45 letter.

Dont know how PBEC is processing the case.
 
It was a non RIR case

The case you guys are referring to was a non RIR (TR) case. The adjudication of those cases is persumably faster at PBEC as compare to RIR cases. I beleive from all the news in the forum, the RIR case are still stuck at April 2001. Doesnt seem like the misery will end anytime soon.

Yes my case went on Aug7th to Atlanta DOL, I sent a email from my company email id, i got response and my lawyer responded with fulfilling the querry's for Employer address proof.
I am still in dilemma whats happening over there, they should have responded by now, but i dont know how to find out about my case status, i should send them an 7th year extention letter, i think they will do it.
I work for a client who is Fed Gov, may be that email id with name@name.gov, would have got me fast response.
I am just guessing...??

If everything goes well they should have responded to me by now......

tell me guys how to find out, my H1 visa for 6th year is going to expire on July 2006.

7th year extension

I have a slightly different opinion based on the document from following link. http://uscis.gov/graphics/lawsregs/handbook/AC21intrm051205.pdf.

I am reproducing relevant portion of the text from page 7-8 applicable for H-1B petitions extensions.

“Section 106(a) of AC21 allows an alien to obtain an extension of H-1B status beyond the 6-year maximum period, when:
A. 365 days or more have passed since the filing of any application for labor certification, Form ETA 750, that is required or used by the alien to obtain status as an EB immigrant, or
B. ………..
Once these requirements have been met, the alien may be granted an extension beyond the 6-year maximum on or prior to the date the alien reaches the 6-year maximum. Such extensions may only be granted in one-year increments, but may be requested on a single (combined) extension request for any remaining time left in the initial 6-year period. Requiring the filing of two extension petitions merely increases petitioner and CIS workloads, and has no basis in statute. In no case, however, may the total period of time granted on an extension exceed a cumulative total of 3 years. 8 CFR 214.2(h)(15)(ii)(B)(1).”

In short, it says one can apply for 7th year extension when (s)he is left less than two years to complete 6 year H-1B period. Any one has different opinion?
