Hi kam1970,

For me, Philly replied immediately saying "At this time, we are unable to provide any status information on Permanent Labor Certifications. Please contact your employer or attorney." Dallas replied in 4-5 days with "The new case number is: NOT YET ASSIGNED". Be patient, I suspect with the number of emails, they are taking longer to respond. Plus they can only provide info if the case is already entered in their database.

The Atlanta Region stopped processing all LC at the end of February. This week they are sending out the last approval notice or faxing to the lawyer’s office about those unprocessed cases to be forwarded to the Philadelphia BEC. You may want to check it with your employer or lawyer and see whether you are the last luckiest one before the new LC system. You may also want to talk to the specialist if you know who processes your case.
 
My Attorney is also received 45 Day Letter, it is a two page(s), first one is covering and 2nd is for confirmation have check option [ ] want to withdraw application, [ ] want to continue processing, Signature and date, My Attorney faxed this morning...let's see what happen now...

Finally they're sending to Employer as well as Attorney

Guys,
What happened no postings today, no messages, I feeling that still they have not yet started sending 45 letters for atlanta, when i called my advocate he told me that he received two more letters but it's not IT related, but he told that he may receive any moment.he told that he received 2 letters of jan 2003 and aug 2003(not IT)
so iam guessing still they are not completely started sending letters, only few cases by mistake they would have sent.
If they start working on atlanta cases alteast few of us would have got it by now???
so lets seeeeeeeeeeee how many mooooooooore days we should sail in this big ship to reach the destination.(I am thinking without water how can we sail in the ship.........without dol support how can we get this letters and get our GC approvals.............)
Really iam going mad with this new rules..............

Good news on I-140 and I-485

Texas USCIS Service Centre reports (as of March 4, 2005) that it is processing I-140 cases, both EB2 and EB3, for November 8, 2004. It is the fastest movement that I have seen in that date for a long time.

So we are effectively talking about 5 month delay in getting I-140 approval. Even if people have to wait for I-1485, they have greater freedom under AC 21 portability to switch jobs if the I-140 is approved.

Also under AC 21 (American Competitiveness in the 21st Century Act), if the I-140 is approved and the person is awaiting Adjustment of Status, H1-B visa can be renewed for a period of 3 years, even after completion of 6 years. There is some section 104(c) or 106. Check with ur attorneys. Saves a lot of money, tension and hassle of renewing H1-B visa and the dependents visa every year. Come to think of it, u will have to renew ur driver's license every time u extend ur visa as ur exisitng license expires with ur visa.



Some good had to come out of the entire exercise of trying to eliminate the backlogs. The interview procedure / requirements for I-1485 have been simplified. Read the pdf document on the immigration.com site.

Interview is proposed to be waived for employment based cases where the principal applicant is employed with the same petitioner who submitted the approved underlying employment-based visa petition. This is of course subject to various checks against fraud etc but should be a big relief to a lot of people.
 
Changing jobs after I-140

Tampabelle ... Are you sure that one can change jobs after getting I-140 apprval ? I was under the impression that it was not possible.
Does it require some degree of understanding from the current employer that he won't revoke my I-140 etc ?
Give me more info ... you are giving me some hopes !!!
 
After your I-140 is approved and your I-485 is pending for at least 180 days, your employer shall forfeit the right to withdraw your I-140.

Are you sure the post 6 years H-1B can be renewed for a period of 3 years rather than additional one-year increments? Have you seen any post 6 years H-1B has been extended for another 3 years? In fact, the post 6 years H-1B can be only extended year by year until the green card is granted.

BTW, how about your resubmission of I-140/I-485 with the LC? Has your I-485 been accepted or only I-140?

As I post earlier...Employer and the Attorney both get 45-day letter, Has noting on it...1st page is just covering type of thing...2nd page has confirmation sheet...either one can send/fax to the BPC, in my case my Attroney sent fax...I hope this will help

BTW..Attorney doesn't have any idea, how long it takes..after this step, Now another waiting game started!

The letter actually came from the Atlanta Regional Office (rather than the BEC), and your lawyer fax it to the BEC, correct? Lots of people may make an email inquiry to the BEC. It may be useless before the BEC gets your file.

According to the AILA, the status of current processing of backlog cases at the Dallas and Philadelphia Backlog Processing Centers is as follows:

Total number of cases received from the state offices: Over 180,000.

Total number of cases completed data-entry: Approximately 86,000. Plans to complete the data-entry for all cases by the end of summer 2005. After data entry is completed on all cases, the workers would move over to processing.

Total 45-day letters issued: Over 40,000.

Timeframe for review of cases by contractors: Contractors are currently being trained. Once data entry is completed on all cases, they would move over to processing of applications.

Processing standards: They will apply the standards of each Region rather than national uniform standards. Therefore, the variance in recruitment requirement and other standards among the previous 6 Regions will be preserved.

FIFO rule: Uniform national queue regardless of the occupations.
It appears that people needs a patience.

only my company got the letter 14 days ago, and my lawyer got nothing now.
Form 750 should be sent to the lawyer.
we are asked to add some information about the lawyer on 750 froms.
